Extending the Implementation of the Lifeline Rate, Amending R.A. No. 9136 (Electric Power Industry Reform Act of 2001)
Republic Act No. 10150, enacted on June 21, 2011, amends Section 73 of the Electric Power Industry Reform Act of 2001 to extend the implementation of the lifeline rate, a socialized pricing mechanism for marginalized end-users, for an additional 20 years. The Energy Regulatory Commission (ERC) is tasked with determining the consumption levels and rates, which will remain exempt from the cross-subsidy phase-out unless further extended by law. The act includes a separability clause, ensuring that if any provision is found unconstitutional, the remaining parts will remain effective. It also contains a repealing clause for any conflicting laws and will take effect 15 days after publication in two newspapers.
