In accordance with the pertinent provision of Republic Act (R.A.) 7722 otherwise known as the Higher Education Act of 1994, and pursuant to CEB No. R003-2012 dated April 4, 2012 of the Commission en Banc Meeting, the amendment on CMO NO. 03, S. 2012, "ENHANCED POLICIES, GUIDELINES AND PROCEDURES GOVERNING INCREASES IN TUITION AND OTHER SCHOOL FEES, INTRODUCTION OF NEW FEES, AND FOR OTHER PURPOSES" are hereby adopted as follows:
Section 7.2.2 The Certificate of Intended Compliance (COIC) and Section 7.2.3 The Certificate of Compliance (COC) are hereby amended to read as follows:
"Section 7.2.2. The Certificate of Intended Compliance (COIC) shall state that:
FOR INTENDED INCREASE IN TUITION, seventy percent (70%) of the incremental proceeds of tuition fee increases shall be used for the benefit of teaching and non-teaching personnel and other staff, except those who are principal stockholders of the HEI, including such increases as may have been provided for in the Collective Bargaining Agreement (CBA), if any, existing or in force at the time when Republic Act (RA) 6728 took effect. The COIC shall be certified under oath by the school head. HEISca
"Section 7.2.3. The Certificate of Compliance (COC) shall state that:
FOR INCREASE IN TUITION, seventy percent (70%) of the incremental proceeds of tuition fee increases are being used for the benefit of teaching and non-teaching personnel and other staff, except those who are principal stockholders of the HEI, including such increases as may have been provided for in the Collective Bargaining Agreement (CBA), if any, existing or in force at the time when Republic Act (RA) 6728 took effect. The COC shall be certified under oath by the school head.
All previous issuances inconsistent with this guideline are deemed repealed, revoked or rescinded accordingly.
This guideline shall remain in force and effect until revoked or amended.
