DENR Administrative Order No. 004-16 designates the Naga River Watershed as a Water Quality Management Area (WQMA) in accordance with the Philippine Clean Water Act of 2004. This order aims to improve and protect the water quality of the Naga River for sustainable use and tourism, while enhancing collaboration among local government units (LGUs) and stakeholders. A Governing Board is established to oversee the WQMA, consisting of representatives from various government agencies and local sectors, tasked with formulating rules, monitoring compliance, and drafting action plans. The order emphasizes the importance of public education and participation in water quality management initiatives. It will take effect 15 days after publication and registration.

SUBJECT : Designation of the Naga River Watershed Water Quality Management Area and the Creation of its Governing Board

 

Pursuant to Section 5 of RA 9275 otherwise known as the Philippine Clean Water Act of 2004, DENR Administrative Order (DAO) No. 2005-10 or the Implementing Rules and Regulations of RA 9275, and DENR Memorandum Circular 2009-15 or Procedural Manual for the Designation of Water Quality Management Areas, and considering its critical importance to the City of Naga, Province of Camarines Sur and its communities, the Naga River Watershed is hereby designated as Water Quality Management Area (WQMA).

SECTION 1. Policy and Objectives. — It is the policy of the State to pursue economic growth in a manner consistent with the protection, preservation and revival of the quality of our fresh, brackish and marine waters. Pursuant to this policy statement, this Order aims at protecting and improving the water quality of Naga River to make it a sustainable resource for the people of Naga City, consistent with the following water quality management objectives:

a) To improve the water quality of Naga River, making it suitable for beneficial uses that will help enhance the city as a tourist destination, since it is the home of the Peñafrancia fluvial procession;

b) To provide procedures relative to the prevention, control and abatement of water pollution of the Naga River and its watershed through a comprehensive management program for water pollution control; CAIHTE

c) To support environmental protection initiatives and programs being undertaken by the Naga River Development Council and strengthen the implementation of Naga City ordinances in relation to the abatement and control of water pollution;

d) To formulate a program on water quality management which links water quality management issues to ecological protection, water supply, public health and quality of life;

e) To promote public information and education for stakeholders of the WQMA and encourage the participation of an informed and concerned public in water quality management and monitoring;

f) To promote LGU and stakeholder collaboration and cooperation through coordinated efforts in protecting, managing and sustaining acceptable quality of water in the Naga River Watershed; and

g) To harness locally available resources to support the Naga River Revitalization Project and protection efforts for the Naga River.

SECTION 2. Coverage. — The Naga River Watershed WQMA shall cover its natural or man-made tributaries that are within the WQMA boundary including the land embraced by the hydrologic unit identified through various maps.

The WQMA is bounded by the following geographic coordinates which are consistent with the map in Annex A:

SECTION 4. Creation of the WQMA Governing Board. — A WQMA Governing Board is hereby created, which shall be chaired by the Regional Director (RD) of the Environmental Management Bureau (EMB) Region V, and shall have the following members:

a) Duly authorized representative from the Office of the Governor, Province of Camarines Sur;

b) Duly authorized representative from the Office of the Mayor, of the following cities/municipalities:

1) City of Naga

2) Municipality of Pili

c) Regional Director or duly authorized representative from the following government offices in Region V:

1. National Economic and Development Authority;

2. Department of Agriculture; aDSIHc

3. Department of Education;

4. Department of Health;

5. Department of the Interior and Local Government;

6. Department of Public Works and Highways;

7. Department of Science and Technology;

8. Department of Tourism;

9. Department of Trade and Industry;

10. Bureau of Fisheries and Aquatic Resources;

11. National Irrigation Administration;

12. Philippine Information Agency

d) Duly authorized representative from the National Water Resources Board (NWRB);

e) Duly authorized representative from the Department of Environmental and Natural Resources, Region V;

f) Duly authorized representative of the Naga River Management Council;

g) Area representative of the following sectors:

1) Academe

2) Business/Industry

3) Water Utility

4) Duly registered Non-Government Organizations/Local Peoples' Organizations/Civil Societies involved in Natural Resources; Management or Environmental Concerns ETHIDa

5) Representative from Municipal Fisheries and Aquatic Resources Management Council;

The Board may also invite representatives from other agencies/institutions to participate in the deliberations of the Board as needed.

The terms, vacancy and compensation of expenses of the Governing Board shall be governed by DAO 2005-10. The Local Chief Executive and Heads of Offices may appoint/authorize their respective representatives to the Board, provided that he/she is authorized to make commitments on behalf of the office he/she represents. Provided, further, that the LGU representatives in other WQMAs shall also serve as representative in the Naga River WQMA.

Representatives from the business sector and peoples' organizations/non-government organizations/civil society shall be designated in accordance with the procedure and requirements laid down in DAO 2005-10.

SECTION 5. Functions of the Governing Board. — The Governing Board shall have the following functions:

a) Formulate the Governing Rules that will ensure effective management of the WQMA Governing Board;

b) Effect other officers and create working committees within the Board that are deemed necessary for the effective implementation of WQMA policies, programs, and activities;

c) Review and adopt the WQMA Action Plan drafted by the EMB Region V in accordance with the Integrated Water Quality Management Framework. Thereafter, prepare succeeding action plans for submission to the DENR;

d) Together with EMB Region V, assist the Local Government Units in preparing the LGU Compliance Scheme to implement the WQMA Action Plan and drafting local legislation to protect the Naga River Watershed and promote overall environmental improvement in the WQMA area; cSEDTC

e) Monitor and facilitate the compliance with the WQMA Action Plan by the local government units;

f) Formulate strategies to harmonize policies/regulations/local legislation necessary for the effective implementation of R.A. 9275 in accordance with those established in the Integrated Water Quality Management Framework;

g) Recommend local and national legislation that will protect the water quality of Naga River Watershed;

h) Coordinate relevant activities among its members, agencies, and facilitate resolution of conflicts;

SECTION 13. Effectivity. — This Order shall take effect fifteen (15) days after its publication in a newspaper of general circulation and fifteen (15) days after its registration with the Office of the National Administrative Register (ONAR).
