Defining the Policy on the Expropriation of Private Property for Socialized Housing
Presidential Decree No. 1224, issued on October 21, 1977, establishes the policy for the expropriation of private property for socialized housing in the Philippines, emphasizing the necessity of just compensation. It clarifies that "public use" includes the acquisition of land for constructing housing for middle and lower-class citizens. The decree stipulates that just compensation will be based on either the owner's declared value or the market value determined by local assessors, whichever is lower. Furthermore, upon filing an expropriation petition and depositing the compensation amount, the government may immediately take possession of the property, even while legal disputes are pending. This policy aims to facilitate social reform through improved housing access.
