Creation of Positions for Six Assistant City Fiscals for Quezon City

REPUBLIC ACT NO. 5292

AN ACT CREATING THE POSITIONS OF SIX ASSISTANT CITY FISCALS FOR QUEZON CITY, INCREASING THE SALARIES OF THE ASSISTANT CITY FISCALS OF QUEZON CITY, AMENDING FOR THE PURPOSE SECTION TWENTY-EIGHT AND SECTION TWENTY-NINE OF THE CHARTER OF SAID CITY

SECTION 1. The first paragraph of Section twenty-eight of Republic Act Numbered Five hundred thirty-seven, otherwise known as the "Revised Charter of Quezon City," as amended, is further amended to read as follows:

"Sec. 28. The City Fiscal, his assistants, his duties. — There shall be a city fiscal who shall be the chief of the law department of the city, a first assistant city fiscal who shall be the assistant chief, a second assistant city fiscal, two third assistant city fiscals, five fourth assistant city fiscals, five fifth assistant city fiscals, seven sixth assistant city fiscals, and six seventh assistant city fiscals, who shall discharge their duties under the general supervision of the Secretary of Justice. The city fiscal, who shall have a rank and the privileges of a judge of a Court of First Instance, shall be the chief legal adviser of the city and all offices and departments thereof and shall have the following general powers and duties."

SECTION 2. Section twenty-nine of the same Act is further amended to read as follows:

"Sec. 29. Compensation of City Fiscal and his assistant. — The City Fiscal and his assistants shall receive the salaries herein set forth, which shall be paid from the funds of the city:

"(a) City fiscal shall have the salary of a Judge of a Court of First Instance.

"(b) First assistant city fiscal, at one thousand two hundred pesos less than that herein provided in the next preceding paragraph.

"(c) Second assistant city fiscal, at nine hundred pesos less than that herein provided in the next preceding paragraph.

"(d) Two third assistant city fiscals, at nine hundred pesos less than that herein provided in the next preceding paragraph.

"(e) Five fourth assistant city fiscals, at nine hundred pesos less than that herein provided in the next preceding paragraph.

"(f) Five fifth assistant city fiscals, at nine hundred pesos less than that herein provided in the next preceding paragraph.

"(g) Seven sixth assistant city fiscals, at nine hundred pesos less than that herein provided in the next preceding paragraph.

"(h) Six seventh assistant city fiscals, at twelve thousand pesos per annum.

SECTION 3. Incumbent fiscals of Quezon City, occupying positions affected by the preceding section at the time of the approval of this amendatory Act, shall continue to occupy their respective positions and receive the salary increases herein provided without necessity of any new appointment.

SECTION 4. This Act shall take effect upon its approval.
