ACT NO. 4121
AN ACT TO CREATE THE DEPARTMENT OF LABOR, AMENDING FURTHER SECTIONS SEVENTY-FIVE, SEVENTY-SIX, AND EIGHTY-SIX OF THE ADMINISTRATIVE CODE, DESIGNATE THE BUREAUS TO BE UNDER ITS EXECUTIVE AUTHORITY, CONTROL, AND SUPERVISION, AMEND SECTION THIRTY-FOUR (A) OF ACT NUMBERED FOUR THOUSAND AND SEVEN, AND FOR OTHER PURPOSES
SECTION 1. Section seventy-five of the Revised Administrative Code, as amended by section two of Act Numbered Four thousand and seven, is hereby amended to read as follows:
"SEC. 75. Executive Departments. — There shall be seven executive departments, to wit: the Department of the Interior, the Department of Finance, the Department of Justice, the Department of Agriculture and Commerce, the Department of Public Works and Communications, the Department of Public Instruction, and the Department of Labor, which shall be under the direct control of the respective secretaries of department, exercising their functions subject to the general supervision and control of the Governor-General." SECTION 2. Section seventy-six of the Revised Administrative Code, as amended by section three of Act Numbered Four thousand and seven, is hereby further amended to read as follows:
"SEC. 76. Secretaries of departments. — The Department of the Interior shall perform its functions under the executive authority of the Secretary of the Interior; the Department of Finance shall perform its functions under the executive authority of the Secretary of Finance; the Department of Justice shall perform its functions under the executive authority of the Secretary of Justice; the Department of Agriculture and Commerce shall perform its functions under the executive authority of the Secretary of Agriculture and Commerce; the Department of Public Works and Communications shall perform its functions under the executive authority of the Secretary of Public Works and Communications; the Department of Public Instruction shall perform its functions under the executive authority of the Secretary of Public Instruction, and the Department of Labor shall perform its functions under the executive authority of the Secretary of Labor."
SECTION 3. Section eighty-six of the Revised Administrative Code is hereby amended to read as follows:
"SEC. 86. Bureaus and offices under the Department of the Interior. — The Department of the Interior shall have executive supervision over the administration of provinces, municipalities, chartered cities and other local political subdivisions, the Bureau of Non-Christian Tribes, the Philippine Constabulary, and the Board of Censorship for Moving Pictures. It shall also have the general supervision over matters pertaining to marriage and the registration of priests and ministers."
SECTION 4. Bureaus and Offices under the Department of Labor. — The Department of Labor shall have executive supervision over the Bureau of Labor, the Office of the Inspector-General of Labor, and all Bureaus, divisions and offices hereafter created concerning labor alone or labor in its relations with capital, and also the proper enforcement of all laws relative to labor and capital in the Philippine Islands and over all other matters related with the welfare of the Filipino laborers in this country and abroad.
SECTION 5. Section thirty-four (a) of Act Numbered Four thousand and seven is hereby amended to read as follows:
"SEC. 34. (a) There shall be in the Office of the Secretary of Labor an Undersecretary of Department who shall perform such duties as the Department head may assign to him and as may be imposed upon him by law."
SECTION 6. Salaries of Secretary and Undersecretary of Labor. — The Secretary and Undersecretary of Labor shall receive the same salaries as established by the Appropriation Act of nineteen hundred and thirty-four for the secretaries and undersecretaries of the other executive departments.
SECTION 7. Readjustments by the Governor-General. — The Governor-General is hereby authorized to make all necessary readjustments in the personnel and activities of the other executive departments and to place said personnel and activities under the jurisdiction of the new Department of Labor, in which case the appropriations for said personnel and activities shall be transferred to said Department.
SECTION 8. Date of Taking Effect. — This Act shall take effect on May first, nineteen hundred and thirty-four.
