The committee, chaired by the Bureau of Customs and involving other key government departments, aims to enhance the enforcement of consumer protection laws and ensure environmental protection during the process. Responsibilities include coordinating efforts among implementing agencies, formulating regulations, and engaging with other government entities regarding procedures for handling non-compliant products. The order is effective immediately and will remain in force until its objectives are met.

CUSTOMS SPECIAL ORDER NO. 037-08

SUBJECT : Creation of an Inter-Agency Committee to Deal on the Condemnation/Re-Exportation of Imported Products Not Admitted Under the Consumer Act of the Philippines

 

1. OBJECTIVES

1.1 To properly and effectively implement the pertinent provisions of the Consumer Act of the Philippines (R.A. No. 7394), more particularly Article 15 of the said Act.

1.2 To include in the decision making-making process and in the implementation activities the "Implementing Agencies" named in the Consumer Act as well as the government agency tasked by law to protect the environment, especially in case of condemnation of products.

1.3 To spearhead the enforcement of the same and to enlist the assistance of other groups, services, units and personnel of the participating "Implementing Agencies". ECcaDT

2. ADMINISTRATIVE PROVISIONS

2.1 Subject to confirmation by the Heads of the concerned agencies, there shall be created an Inter-Agency Committee on the Condemnation/Re-Exportation of Imported Products Not Admitted under the Consumer Act of the Philippines to be composed of the following:

Bureau of Customs Chairman
Department of Health, Bureau of Food and Drugs Vice Chairman
Department of Agriculture Member
Department of Trade and Industry Member
Department of Environment and Natural    
Resources, Environment Management Bureau Member

3. OPERATIONAL PROVISIONS

The Inter-Agency Committee created under this Order shall include the following duties and responsibilities:

3.3 To coordinate the "Implementing Agencies" efforts in formulating proposed laws, rules and regulations, and orders relative to controls to be imposed against the entry of imported consumer products found to be in violation of the provisions of the Consumer Act of the Philippines.

3.4 To interact and coordinate with other government agencies/offices relative to the requirements/needs of the Inter-Agency Committee on the procedure to be undertaken on the condemnation/re-exportation of imported articles not admitted under the Consumer Act of the Philippines.

3.5 To do such other acts as may be necessary and reasonable in carrying out this Order.

Further, the Inter-Agency Committee shall have a Secretariat, to be headed by Atty. Caesar T. Corpus, AOCG, who shall act as the central coordinating body of the Committee. DHSaCA

This Order shall take effect immediately and shall cease upon the attainment of the objective.
