Collection of Legal Research Fee in Ombudsman Clearance Applications

OMBUDSMAN OFFICE CIRCULAR NO. 09-16

 

WHEREAS, Memorandum Circular No. 05, series of 2012, dated 16 October 2012, provided the Guidelines on the Issuance of Ombudsman Clearance to set up control mechanisms in preserving the integrity of the Ombudsman Clearance as an official document used in the processing of appointments, promotions, retirements, transfers, resignations, travels, grants of service awards and scholarships in the public service, and for other purposes;

WHEREAS, Office Circular No. 07, series of 2014, dated 28 January 2014, authorized the collection of processing fees based on a schedule depending on the purpose;

WHEREAS, Republic Act No. 3870 1 mandates the collection of a legal research fee (LRF) by agencies or tribunals exercising quasi-judicial functions to provide support to the University of the Philippines Law Center (UPLC) and the University of the Philippines Law Complex for every application, paper, or document seeking official action to establish a status, right, privilege or particular fact;

WHEREAS, the Office of the Ombudsman is mandated to collect the LRF on behalf of the UPLC as it is a government agency that acts on applications for the establishment of a status, right or privilege as it processes and issues clearances to the public;

NOW, THEREFORE, in view of the foregoing, the undersigned hereby amends Office Circular No. 07 to reflect the following schedule of processing and legal research fees for the application of Ombudsman Clearance:

All special collecting officers are hereby mandated to reflect the breakdown of clearance and legal research fees in all Official Receipts issued to applicants.
