CESB RESOLUTION NO. 1036-12
CLASSIFYING THE POSITIONS OF DIRECTOR IV AND DIRECTOR III IN THE GOVERNANCE COMMISSION FOR GOVERNMENT-OWNED AND CONTROLLED CORPORATIONS AS CES POSITIONS
WHEREAS, Article IV Part II of the Integrated Reorganization Plan provides that the Board shall promulgate rules, standards and procedures on the selection, classification, compensation and career development of members of the Career Executive Service (CES); THaCAI
WHEREAS, CESB Resolution No. 799, s. 2009, defines the coverage of the CES, to wit: (a) the position is a career position; (b) the position is above Division Chief; and (c) the duties and responsibilities of the position require the performance of executive and managerial functions;
WHEREAS, CESB Resolution No. 945, s. 2011, which has clarified the Coverage of the CES provides that for career service positions requiring Presidential appointments expressly enumerated under Section 7 (3), Chapter 2, Subtitle A, Title 1, Book V of the Administrative Code of 1987 namely, Undersecretary, Assistant Secretary, Bureau Director, Assistant Bureau Director, Regional Director, Assistant Regional Director, and Chief of Department Service, no classification of positions is necessary to place them under the coverage of the CES, except if they belong to Project Offices, in which case a position classification is required, in consultation with the DBM;
WHEREAS, Governance Commission for Government-Owned and Controlled Corporations (GCG) was constituted under Republic Act No. 10149 (RA No. 10149),otherwise known as the "GOCC Governance Act of 2011";
WHEREAS, under RA No. 10149, the GCG is created to act as a "central advisory, monitoring, and oversight body with authority to formulate, implement and coordinate policies" governing government-owned and controlled corporations (GOCCs),government financial institutions (GFIS),government instrumentalities with corporate powers (GICP) and government corporate entities (GCE).All these bodies have been collectively referred to as GOCCS, which, according to the tentative listing given to the Commission, consist of a total of one-hundred-fifty eight (158) GOCCs;
WHEREAS, GCG wrote the CESB Secretariat and submitted a machine copy of GCG's Department of Budget and Management (DBM) approved Notice of Organization, Staffing and Compensation Action (NOSCA);
WHEREAS, GCG has five (5) Director IV and three (3) Director III based in the DBM approved plantilla position, all of whom are to be appointed by the President; TSADaI
WHEREAS, the eight (8) Directors will be assigned to manage the Corporate Standards Office, Corporate Governance Office A, Corporate Governance Office B, Administrative and Finance Office and Legal Office, respectively;
WHEREAS, the above Director positions are career service positions requiring Presidential appointments as expressly enumerated under Section 7 (3), Chapter 2, Subtitle A, Title 1, Book V of the Administrative Code of 1987 namely: Undersecretary, Assistant Secretary, Bureau Director, Assistant Bureau Director, Regional Director, Assistant Regional Director, and Chief of Department Service.
NOW THEREFORE, foregoing premises considered, the Board RESOLVES, as it hereby RESOLVED, to note the inclusion of eight (8) executive/managerial positions at the GCG as part of the CES as follows:
