The NAPOLCOM Memorandum Circular No. 18-95, issued on August 28, 1995, clarifies the mandatory training requirements for rank adjustments or promotions of uniformed members of the Philippine National Police (PNP). It states that completion of a higher-level training course accredited by the Philippine Public Safety College (PPSC) can offset the mandatory training requirement for those temporarily promoted or adjusted in rank. However, this provision does not apply to individuals promoted to the rank of Police Senior Superintendent without completing the Officer Senior Executive Course or those who were promoted without undergoing the Basic Recruit/In-Service Training Course. The circular rescinds any inconsistent policies and takes effect immediately.

CLARIFYING THE POLICY ON MANDATORY TRAINING REQUIREMENT FOR PURPOSES OF RANK ADJUSTMENT OR/AND PROMOTION OF UNIFORMED MEMBERS OF THE PHILIPPINE NATIONAL POLICE

WHEREAS, under Section 14 (d), RA 6975, this Commission is empowered to "foster and develop policies and promulgate rules and regulations, standards and procedures to improve police services based on sound professional concepts and principles;"

WHEREAS, in line with this legal provision, this Commission has enacted Memorandum Circular Nos. 92-007 dated 8 September 1992 and 92-008 dated 7 October 1992 detailing the PNP Officers Career Management and Development Program and PNP Non-Officer Career Management and Development Program, respectively, providing for appropriate training as mandatory requirement for rank adjustment or/and promotion in permanent status for all PNP uniformed ranks;

WHEREAS, notwithstanding the above policy, several PNP officers and non-officers were extended rank adjustment or/and promotion in temporary status to their respective next higher grades due to lack of the mandatory training requirement but have subsequently taken higher level training courses;

WHEREAS, there is a need to provide standard policy guidelines treating higher level training courses to offset the mandatory training requirement for PNP uniformed members who were adjusted in rank or/and promoted in temporary status to their next higher grades; ISHCcT

NOW, THEREFORE, pursuant to its constitutional mandate to administer and control the PNP, this Commission prescribes the following guidelines:

SECTION 1. In general, the completion of a higher level training course duly accredited by the Philippine Public Safety College (PPSC) shall be considered as appropriate for the purpose of offsetting the mandatory training requirement of a PNP uniformed member who has been extended a rank adjustment or/and promotion to the next higher grade in temporary status.

SECTION 2. The above provision shall not apply to the following situations:

a. Those promoted/rank adjusted to the grade of Police Senior Superintendent without undergoing the Officer Senior Executive Course (OSEC) or its equivalent; and

b. Those who were recruited into the PNP service and thereafter subsequently promoted/rank adjusted to the next higher rank without undergoing the Basic Recruit/In-Service Training Course as offered/accredited by the PPSC.

SECTION 3. All policies, directives and issuances inconsistent with or contrary to the provisions of this Memorandum Circular are hereby rescinded or modified accordingly.

SECTION 4. This Memorandum Circular takes effect immediately.
