Clarification on the Matter of Disposal of Batas Pambansa Blg. 22 Cases with Unpaid Filing Fees Pursuant to Supreme Court Circular No. 57-97 Dated 16 September 1997
OCA Circular No. 141-03 provides procedural guidelines regarding the disposal of cases under Batas Pambansa Blg. 22 that have unpaid filing fees. Complainants are given ten days to pay these fees upon receipt of notification; failure to do so will result in the case being archived. After two months, the case will be forwarded to the appropriate judge for dismissal due to non-payment. The Clerk of Court is then instructed to return the case folder to the Office of the Prosecutor. This circular serves to clarify the process for all judges, clerks, and legal practitioners involved.
