Change of Designation of Lt. Gov. to Governor of Guimaras Sub-province, Iloilo

REPUBLIC ACT NO. 5682

AN ACT CHANGING THE DESIGNATION OF THE LIEUTENANT-GOVERNOR TO GOVERNOR OF THE SUB-PROVINCE OF GUIMARAS, PROVINCE OF ILOILO, AND CREATING IN SAID SUB-PROVINCE THE POSITIONS OF FISCAL AND DIVISION SUPERINTENDENT OF SCHOOLS

SECTION 1. Effective upon the approval of this Act, the lieutenant-governor of the Sub-province of Guimaras, Province of Iloilo, shall henceforth be called Governor and shall exercise all executive powers vested under existing laws in a provincial governor. casia

SECTION 2. Ninety per centum of all provincial taxes, fines or other revenues collected in the Sub-province of Guimaras or by reason of any right originating therein shall accrue to the treasury of said sub-province for the sole use and benefit thereof. The remaining ten per centum of such collections shall accrue to the general fund of the province: Provided, however, That the collections belonging to the road tax shall accrue in their entirety to the treasury of said sub-province.

SECTION 3. There are hereby created the positions of fiscal and division superintendent of schools in the Sub-province of Guimaras, which offices shall be organized within thirty days from the approval of this Act. Appointment to the position of fiscal shall be made in accordance with existing laws except the division superintendent of schools who shall be appointed as hereafter provided, and the appointees thereof shall exercise such powers and perform such duties as are vested in the office by law as if the Sub-province of Guimaras were a different and separate province with their seat of office in the capital of the sub-province. Within thirty days after the approval of this Act, the offices herein created shall be provided with their corresponding clerks and other necessary helps by the Provincial Board of Iloilo. The division superintendent of schools shall be appointed by the President of the Philippines with the consent of the Commission on Appointments, provided that the appointee shall be a holder of the degree of Master of Arts and shall have no less than fifteen years of actual official connection with the Philippine public elementary school system, at least five years of which shall be in a supervisory capacity. cd

SECTION 4. All acts, executive orders and rules and regulations inconsistent with the provisions of this Act are hereby repealed or amended accordingly.

SECTION 5. This Act shall take effect upon its approval.
