Authorizing the Legitimate Parent of Minor or Incompetent Person to Receive Payment of Claim Against Government
Republic Act No. 21, enacted on September 25, 1946, allows the legitimate father, or the mother in his absence, of a minor or incompetent person to receive payments for claims against the Philippine or U.S. government, provided the amount does not exceed five hundred pesos. This authority is granted without the need for court appointment as a guardian, except under specific conditions where the parent is deemed unfit, such as being insane, a habitual criminal, or having abandoned the minor. The law aims to streamline the process for receiving small claims for the benefit of minors and incompetents. It took effect immediately upon approval but was not published in the Official Gazette.
