SUPREME COURT MEMORANDUM ORDER NO. 02-12
AUTHORIZING THE GRANT AND RELEASE OF FRINGE BENEFIT TO THE JUSTICES, OFFICIALS AND PERSONNEL OF THE SUPREME COURT, PRESIDENTIAL ELECTORAL TRIBUNAL, COURT OF APPEALS, SANDIGANBAYAN, AND COURT OF TAX APPEALS
WHEREAS, by virtue of, and pursuant to, his authority under the General Appropriations Act and the resolutions of the Constitutional Fiscal Autonomy Group (CFAG), the Chief Justice may grant and authorize the release of fringe benefits to the justices, officials and personnel of the Supreme Court and the appellate courts from the savings from their respective appropriations;
WHEREAS, the grant of fringe benefit, in the concept of productivity enhancement incentive, is highly justified in recognition of the commendable performance and contribution of the members and personnel of the judiciary in attaining efficiency in the operations of the courts;
WHEREAS, as reported by the Fiscal Management and Budget Office (FMBO) of the Supreme Court, there are enough savings from the regular appropriations of the Supreme Court and the Presidential Electoral Tribunal (PET) to cover funding requirements for the grant of fringe benefit in the amount of TEN THOUSAND PESOS (P10,000.00) for each of the justices, officials and personnel of the Supreme Court and the PET;
WHEREAS, fringe benefit in the amount of TEN THOUSAND PESOS (P10,000.00) may likewise be granted to each of the justices, officials and personnel of the three appellate courts (the Court of Appeals, the Sandiganbayan and the Court of Tax Appeals) chargeable against the respective savings from the regular appropriations of the said appellate courts, as certified to by their proper officials, provided that they have not received similar benefits; otherwise, only the difference will be paid;
IN VIEW OF THE FOREGOING, the Chief Justice hereby authorizes the grant and release of fringe benefit, as follows: HTCIcE
(1) TEN THOUSAND PESOS (P10,000.00) to each justice, official and personnel of the Supreme Court and the PET, which shall be charged against the respective savings from the regular appropriations of the Supreme Court and the PET;
(2) TEN THOUSAND PESOS (P10,000.00) to each justice, official and personnel of the Court of Appeals, Sandiganbayan and Court of Tax Appeals, which shall be charged against the respective savings of the three appellate courts, provided that they have not received similar benefits; otherwise, only the difference will be paid.
The benefit herein granted shall be received in its full amount by those who are still in the service, as of November 30, 2011, and shall be subject to the implementing guidelines hereto attached.
This Memorandum Order takes effect immediately and shall forthwith be implemented by the Clerk of Court of the Supreme Court, the Chiefs of the Office of Administrative Services and the FMBO of the Supreme Court.
Likewise, the Presiding Justices of the Court of Appeals, Sandiganbayan and the Court of Tax Appeals shall implement this Memorandum Order insofar as their respective appellate courts are concerned.
