Executive Order No. 207, issued on June 2, 2016, revises the rules governing the assignment of military and police personnel to former Presidents of the Philippines and their immediate families. It establishes that each former President is entitled to a total of twelve military assistants and security personnel, while their spouses or widows may receive six. The order aims to create a coherent set of regulations for such assignments, ensuring that the professional growth of military personnel is not hindered. EXECUTIVE ORDER NO. 207

PROVIDING FOR THE ASSIGNMENT OR DETAIL OF MILITARY AND POLICE PERSONNEL TO CERTAIN INDIVIDUALS AND AMENDING FOR THE PURPOSE EXECUTIVE ORDER (EO) NO. 41 (S. 1966)

WHEREAS, EO No. 41, entitled "Promulgating Rules and Regulations Governing the Detail or Assignment of Military Personnel to Civilian Offices and Officials," provides that the Chief of Staff of the Armed Forces of the Philippines (AFP) may authorize an Armed Forces security to any civilian office, official, or to any private entity upon request when such detail in his opinion would be in the public interest;

WHEREAS, AFP Circular No. 2 (s. 2003) provides that a former President of the Philippines is entitled to two (2) Military Assistants and six (6) enlisted personnel, while the widow of a former President is entitled to three (3) enlisted personnel;

WHEREAS, National Police Commission (NAPOLCOM) Circular No. 2009-004 provides that a former President of the Philippines is entitled to four (4) protective security personnel, while the spouse of a former President is entitled to two (2) such personnel; and

WHEREAS, there is a need to establish a uniform and coherent set of rules and procedures governing the detail and assignment of personnel from both the AFP and Philippine National Police (PNP) to the aforementioned individuals.

NOW, THEREFORE, I, BENIGNO S. AQUINO III, President of the Philippines, by virtue of the power vested in me by law, do hereby order:

SECTION 1. Coverage. — The following private individuals are entitled to Military Assistants, Military and Police Security Detail, subject to pertinent laws, rules and regulations concerning the approval and duration of the assignment or detail:

a. Each former President of the Philippines shall be entitled to a total of twelve (12) Military Assistants, Military Security Detail and/or Police Security Detail, in such combination as he may determine; and

b. Each spouse or widow, as the case may be, or next of kin as may be identified by the former Presidents, shall be entitled to a total of six (6) Military Security Detail and/or Police Security Detail, in such combination as the entitled individual may determine.

The above-entitled individuals may specify the names and grades of the Military Assistants, Military and Police Security Detail to be assigned or detailed to them, including members of the Presidential Security Group (PSG) who have rendered their service to former Presidents during the latter's tenure; Provided, that the professional growth of the AFP, PNP and PSG officers concerned will not be disturbed. The detailed officers/personnel shall receive the same emoluments and allowances from the appropriations of the AFP and PNP, as the case may be, as those assigned or rendering service in their respective branches of service in consonance with pertinent laws, rules and regulations.

SECTION 2. Definition of Terms. — As used in this Order, the following terms shall be construed as follows:

a. Military Assistant. — A commissioned officer of the AFP, including the PSG, in the active service detailed and attached to a civilian government office, official or individual for the purpose of rendering professional aid.

b. Security Detail. — A personnel of the AFP, PNP and PSG detailed to civilian government offices, officials or individuals for the purpose of providing security and ensuring their safety.

SECTION 3. Amendment and Repeal. — The affected provisions of EO No. 41 are hereby amended accordingly. All other rules, regulations and issuances, or parts thereof, which are inconsistent with this Order are hereby repealed or modified accordingly.

SECTION 4. Separability. — Should any provision of this Order be declared invalid or unconstitutional, the other provisions unaffected thereby shall remain valid and subsisting.

SECTION 5. Effectivity. — This Order shall take effect immediately.
