NLRC EN BANC RESOLUTION NO. 006-13
WHEREAS, to effectively implement Section II, Rule 2 of the 2012 NLRC Sheriff's Manual on Execution of Judgment and to attain the commitment under the 2011-2016 NLRC Road Map and the Office Performance Commitment Report (OPCR), there is a need to adopt norms of conduct specific to Sheriffs on account of the special nature of their duties and responsibilities;
WHEREAS, the "Code of Conduct of Sheriffs of the National Labor Relations Commission" was presented for consideration of the Commission en banc.
WHEREFORE, RESOLVE AS IT IS HEREBY RESOLVED, that the proposed "Code of Conduct of Sheriffs" is ADOPTED and APPROVED. Thus:
"CODE OF CONDUCT OF SHERIFFS OF THE NATIONAL LABOR RELATIONS COMMISSION"
WHEREAS, the NLRC is a quasi-judicial body tasked to resolve labor disputes fairly, expeditiously, effectively and with least cost to the litigants;
WHEREAS, Sheriffs play a vital role in the enforcement of NLRC judgments;
WHEREAS, there is a need to adopt norms of conduct specific to Sheriffs on account of the special nature of their duties and responsibilities;
NOW THEREFORE, the Code of Conduct of Sheriffs is hereby proposed for the approval of the Commission en banc.
CANON I
Fidelity to the NLRC
SECTION 1. Sheriffs shall be mindful of their role in the dispensation of justice particularly, in the enforcement of judgments, and at all times act with efficiency, professionalism and integrity.
SECTION 2. Sheriffs shall respect the duly constituted authority, the officers of the NLRC and their colleagues.
SECTION 3. Sheriffs shall at all times uphold the dignity of the NLRC and follow the Constitution, laws of the land, the Sheriffs' Manual on Execution of Judgment and other rules and regulations pertaining to the execution of judgment.
CANON II
Performance of Duties
SECTION 1. Sheriffs shall perform their official duties promptly, efficiently, diligently and with utmost courtesy.
SECTION 2. Sheriffs must be mindful of the ministerial nature of their functions. When confronted with situations calling for the exercise of discretion, they shall immediately refer the same to the concerned Commissioner or Labor Arbiter. TcSHaD
SECTION 3. Sheriffs shall not use their position to secure unwarranted privileges or benefits.
SECTION 4. Sheriffs shall not solicit or accept any gift or benefit that shall influence the performance of their official functions.
CANON III
Conflict of Interest
SECTION 1. Sheriffs shall not have any personal interest in monies or properties which are subject of execution.
SECTION 2. Sheriffs or the immediate members of their families shall not take part, directly or indirectly, in any auction sale or bidding conducted in the performance of their duties.
SECTION 3. Sheriffs shall not fraternize with lawyers and party litigants nor recommend lawyers to litigants to avoid suspicion of partiality and impropriety.
INCORPORATION OF RELEVANT LAWS AND RULES
All provisions of pertinent laws, Civil Service rules, issuances of the Chairman and the Commission en banc, are deemed incorporated in this Code.
DATE OF EFFECTIVITY
This Code is hereby approved by the Commission en banc this ____ of _____, 2013 and shall take effect on _______ of __________, 2013.
