GPPB RESOLUTION NO. 01-08

APPROVAL OF THE CUSTOMIZED AGENCY MANUALS OF THE DEPARTMENT OF EDUCATION

WHEREAS, Section 6 of Republic Act (R.A.) No. 9184 provides that to systematize the procurement process, avoid confusion and ensure transparency, the Government Procurement Policy Board (GPPB) shall pursue the development of generic procurement manuals and standard bidding forms for mandatory use by all government agencies; TDCAHE

WHEREAS, the GPPB, in its meeting held last 14 June 2006, approved and adopted the Generic Procurement Manual for use by all agencies effective January 2007;

WHEREAS, the Department of Education (DepEd) was selected as one of the nine (9) pilot agencies that will undertake the Pilot-testing and Customization of the Generic Procurement Manuals;

WHEREAS, the GPPB Inter-Agency Technical Working Group (IATWG), in meetings held last 15 April 2008 and 16 May 2008, reviewed the final draft of the DepEd Customized Agency Manual (CAM) and endorsed for approval the CAM of DepEd, subject to certain conditions.

NOW, THEREFORE, for and in consideration of the foregoing, WE, the Members of the GOVERNMENT PROCUREMENT POLICY BOARD, by virtue of the powers vested on US by law, hereby RESOLVE to approve, as WE hereby approve the Customized Agency Manuals of the Department of Education for its adoption and official use, subject to the following conditions:

a) Incorporation of a provision on conflict of interest in Volume I of the DepEd CAM to explain the rationale behind the disqualification of officials approving procurement contracts;

b) After the grant of exemption by the Procurement Service, inclusion, as an Annex of Volume II of the DepEd CAM, a list of island divisions and schools exempted by the Procurement Service which may be updated periodically;

c) Submission and approval by the GPPB of Volume V of the DepEd CAM on Content Evaluation;

d) Approval by the GPPB of the proposed amendment to Section 53 of the IRR-A of R.A. 9184 to include as an additional instance under negotiated procurement the provision of training venue and the issuance of appropriate guidelines therefor; and,

e) Include a reference to the Principal-Led School Building Program under Volume I — Foreign Assisted Projects of the CAM of DepEd and attached the prescribed procedures, as an Appendix, on Volume III thereof.

A revised copy of the DepEd's CAM integrating therein the foregoing conditions, including Volume V thereof on Content Evaluation, shall be submitted to the GPPB-Technical Support Office (GPPB-TSO) on or before 30th of August 2008. DECcAS

The GPPB-TSO is directed to verify compliance with the foregoing conditions and report to GPPB for confirmation.

This resolution shall take effect immediately.
