Application for and Grant of Pardon and Parole
Supreme Court Circular No. 066-97, issued on October 14, 1997, mandates that all clerks of court must ensure that commitment orders for prisoners clearly indicate whether the accused has appealed their conviction. This follows the Supreme Court's rulings in People vs. Hinlo and People vs. Francisco Salle, which deemed it illegal to grant or process applications for pardon or parole while an appeal is pending. If an appeal exists, it must be stated whether it has been withdrawn, dismissed, or resolved definitively. For cases prior to this circular, clerks must issue certifications confirming these details upon request from the Bureau of Corrections or the Board of Pardons and Parole. Strict adherence to this directive is required.
