An Act to Provide for an Officer to Act as President of the Philippines under Sections Seven and Nine, Article VII of the Constitution
Commonwealth Act No. 68, enacted on October 23, 1936, establishes procedures for filling a presidential vacancy in the Philippines when neither the President-elect nor the Vice President-elect has qualified. In such cases, the National Assembly is required to convene and elect an acting President by majority vote. If the vacancies in both offices become permanent, the Assembly will decide whether to hold a special election. Until an acting President is elected, a Department Secretary, according to their rank, will temporarily assume presidential duties. This act is effective upon approval.

COMMONWEALTH ACT NO. 68
AN ACT TO PROVIDE FOR AN OFFICER TO ACT AS PRESIDENT OF THE PHILIPPINES UNDER SECTIONS SEVEN AND NINE, ARTICLE VII OF THE CONSTITUTION
SECTION 1. When neither the President-elect nor the Vice President-elect shall have qualified, as provided in section seven, Article VII of the Constitution, or in the event of removal, death, resignation or inability, both of the President and Vice President, as stated in section nine, Article VII of the Constitution, the National Assembly shall forthwith convene and elect, by a majority vote of all its Members, the person or officer who shall act as President until the President-elect or the Vice President-elect shall have qualified, the inability removed, or a President shall have been elected. When the vacancy in the office of President and Vice President shall become permanent, the National Assembly shall determine by resolution whether or not a special election shall be held to elect a President. The call for the National Assembly to convene as herein provided may be made by the Speaker, or the Secretary, or twenty-five Members thereof. CETDHA
SECTION 2. In any of the events mentioned in section one hereof, pending the election of an acting President by the National Assembly, a Department Secretary, in the order of rank established in the Administrative Code, will perform the duties of temporary President.
SECTION 3. This Act shall take effect on its approval.
