COMMONWEALTH ACT NO. 305
AN ACT TO AMEND SECTIONS TWO AND THREE OF ACT NUMBERED THIRTY-FIVE HUNDRED AND EIGHTY-TWO, ENTITLED "AN ACT TO CREATE A BOARD OF CENSORSHIP FOR MOVING PICTURES AND DEFINING ITS FUNCTIONS," AS AMENDED BY COMMONWEALTH ACT NUMBERED ONE HUNDRED AND SIXTY-SEVEN
SECTION 1. Paragraph (a) of section two of Act Numbered Thirty-five hundred and eighty-two, as amended by Commonwealth Act Numbered One hundred and sixty-seven, is further amended so as to read as follows:
"SEC. 2. The Board appointed in accordance with the preceding section shall be known thereafter as "Board of Review for Moving Pictures" and shall be under the control of the office of the Secretary of the Interior and its duties shall be as follows:
"(a) To examine or supervise the examination of all films, spoken or silent, imported or produced in the Philippines, and prohibit the introduction and exhibition of films in this country or the removal of films locally produced from the place of production, which in its judgment are immoral or contrary to law and good customs or injurious to the prestige of the Commonwealth of the Philippines or its people."
SECTION 2. Section three of Act Numbered Twenty-five hundred and eighty-two is amended so as to read as follows:
"SEC. 3. It shall be unlawful for any person or entity to exhibit or cause to be exhibited in any moving picture theater or public place or to remove from its place of production within the Philippines any film not duly passed by the Philippine Board of Review for Moving Pictures and to print or cause to be printed on any film exhibited in any moving picture theater or public place or on any film locally produced a label showing the same to have been officially passed by said Board, knowing that said label has not been previously authorized by the same: Provided, That if the violation is committed by a corporation or association, incorporated or unincorporated, the manager or administrator or the person who has charge of the management or administration of the business shall be criminally responsible therefor.
"For the purposes of this section and of the preceding section, the place of production shall be deemed to be the place of the principal office of the producer within the Philippines, from which the films, whether in their finished of unfinished form, are released for exhibition or other disposition."
SECTION 3. This Act shall take effect upon its approval.
