ACT NO. 2949
AN ACT TO AMEND SECTION TWENTY-SIX HUNDRED AND FIVE OF ACT NUMBERED TWENTY-SEVEN HUNDRED AND ELEVEN, COMMONLY KNOWN AS THE ADMINISTRATIVE CODE, SEPARATING THE OFFICES OF PROVINCIAL SECRETARY AND TREASURER; MAKING THE PROVISIONS OF SECTION TWO THOUSAND AND NINETY-EIGHT OF SAID ACT EXTENSIVE TO THE SPECIALLY ORGANIZED PROVINCES, AND DESIGNATING THE THIRD MEMBER AS SUBSTITUTE OF THE PROVINCIAL GOVERNOR IN CASE OF THE ABSENCE OR INCAPACITY OF THE LATTER
SECTION 1. Section twenty-six hundred and five of Act Numbered Twenty-seven hundred and eleven, known as the Administrative Code, is hereby amended to read as follows:
"SEC. 2605. The provincial board, members of. — The following officers of the provincial government, to wit, the governor, the treasurer, and the third member, shall constitute the provincial board. The provincial governor shall be the presiding officer of the board. In the absence or disability of the provincial governor, or if for any other reason he is unable to perform his official duties, the duties of the provincial governor shall be performed by the third member or by the provincial treasurer according to which of these shall have been previously authorized or delegated by the provincial governor. Copies of all the resolutions of the provincial board and executive orders of the provincial governor shall be furnished the Director of the Bureau of Non-Christian Tribes, under such regulations as he may prescribe."
SECTION 2. The provincial boards of the seven organized provinces of Mindanao and Sulu, the Mountain Province, and Nueva Vizcaya are hereby authorized, subject to the approval of the Secretary of the Interior, to separate the office of the provincial secretary from that of provincial treasurer. The office of provincial secretary so separated shall be filled in the manner prescribed in the third paragraph of section two thousand and ninety-eight of Act Numbered Twenty-seven hundred and eleven, known as the Administrative Code, for the secretaries of the provincial boards of the regular provinces.
SECTION 3. All Acts or parts of Acts inconsistent with the provisions of this Act are hereby repealed.
SECTION 4. This Act shall take effect on its approval.
