IPO OFFICE ORDER NO. 058-10

In the interest of the service, and pursuant to the authority of the Director General under Section 7 of Rep. Act No. 8293, also known as the Intellectual Property Code of the Philippines, Sections 9 and 10 of Office Order No. 128, s. 2003 (Restructuring the Fee Structure of the Intellectual Property Office of the Philippines), are hereby amended, to read as follows:
SECTION 9. Donation to the IPO. — Any lawful Philippine or foreign, natural or juridical, public or private, including international or intergovernmental entity, may donate to the IPOPhil subject to the approval of the Director General and/or duly designated officer.
SECTION 10. Refunds. — Refund may be allowed in case of erroneous or excess payment due to the fault of the IPOPhil and/or the payor, Provided, that the request for refund is filed within one (1) month from the date of payment and is approved by the Director General or a Deputy Director General upon recommendation by either the Director IV or III or Unit Head of the concerned Bureau or Unit. If the request is not filed within the prescribed period or is disapproved, the excess or erroneous payment shall be deemed forfeited in favor of the Government.
All other IPOPhil issuances or any part thereof inconsistent with this Office Order are deemed repealed, amended, and modified. CTacSE
