Amendments to Charter of Baguio City

REPUBLIC ACT NO. 5125

AN ACT FURTHER AMENDING CERTAIN SECTIONS OF THE CHARTER OF THE CITY OF BAGUIO, PROVIDING FOR AN ADDITIONAL JUDGE FOR THE CITY COURT OF BAGUIO, MAKING THE CLERK OF COURT OF THE CITY OF BAGUIO A CITY SHERIFF, AND PRESCRIBING THE MANNER OF HIS APPOINTMENT

SECTION 1. Section two thousand five hundred sixty-two of the Revised Administrative Code, as amended, is further amended to read as follows:

"SEC. 2562.  The city court. — There shall be a city court for the City of Baguio for which three judges shall be appointed. In case of absence, sickness or incapacity of any of the judges of the city court, the Secretary of Justice may designate any assistant attorney of the Department of Justice or provincial fiscal to act as judge of the city court of the City of Baguio, with all the powers of the regular judge of said court; but such acting judge shall not receive any additional compensation during the time he is acting as judge."

SECTION 2.  Section two thousand five hundred sixty two-c of the Revised Administrative Code is amended to read as follows:

"SEC. 2562-c.  The Clerk of the City Court. — There shall be a clerk of the city court, who shall have the same qualifications as that of a clerk of court of a Court of First Instance and who shall be appointed by the President of the Philippines, with the consent of the Commission on Appointments, but this provision on the manner of appointment shall not apply to the present incumbent. He shall also be the sheriff of the city and shall have the same powers and duties as are now provided by law upon provincial and city sheriffs but the exercise of such powers and duties shall be limited to service of processes and other matters relating to cases pending before, or decided by, the City Court of Baguio. As such sheriff he shall be provided with at least two deputy sheriffs and other employees to be paid by the city and their salaries fixed by ordinance. He shall have the rank of an assistant department head of the city and shall receive, payable from the funds of the city, the same rate of salary of the highest paid assistant department head of the city as now fixed or may hereafter be fixed by any law. The clerk of the city court shall keep its seal and affix it to all orders, judgments, certificates, records and other documents issued by the court. He shall record in a summary manner the name of the defendant, the charge against him, the name of the prosecuting witness, the date of the arrest, the appearance of the defendant, the date of the trial, and the nature of the judgment, together with the fines and costs adjudged or collected in accordance with the judgment. He shall have the power to administer oaths. He shall be an ex-officio notary public."

SECTION 3. This Act shall take effect upon its approval.
