ACT NO. 4037
AN ACT AMENDING PARAGRAPHS TWO HUNDRED AND TWO, TWO HUNDRED AND FIVE, AND TWO HUNDRED AND SIXTY-NINE OF THE ACT OF CONGRESS, APPROVED AUGUST FIFTH, NINETEEN HUNDRED AND NINE
SECTION 1. Paragraph two hundred and two, Group one, Class thirteen of the Act of Congress of August fifth, nineteen hundred and nine, entitled "An Act to raise revenue for the Philippine Islands, and for other purposes", is hereby amended to read as follows:
"202. Meat, fresh, chilled and refrigerated, not otherwise provided for, gross weight, one hundred kilos, four dollars. On and after the first day of January, nineteen hundred and thirty-five, five dollars for each one hundred kilos.
"Provided, That the containers of the above articles shall be plainly marked with cancelling ink thus: 'IMPORTED'."
SECTION 2. Paragraph two hundred and five, Group one, Class thirteen of the same Act of Congress of August fifth, nineteen hundred and nine, entitled "An Act to raise revenue for the Philippine Islands, and for other purposes", is hereby amended to read as follows:
"205. Lard and substitutes thereof, not otherwise provided for, including peanut oil and imitations thereof, gross weight, one hundred kilos, six dollars.
"Provided, That the containers of the above articles shall be plainly marked with cancelling ink thus: 'IMPORTED'."
SECTION 3. Paragraph two hundred and sixty-nine, Group seven, Class thirteen of the same Act of Congress of August fifth, nineteen hundred and nine, entitled "An Act to raise revenue for the Philippine Islands, and for other purposes", is hereby amended to read as follows:
"269. Eggs, not otherwise provided for:
"(a) Fresh or preserved, in natural form, eight dollars per one hundred kilos.
"(b) Egg powders, and other preparations of eggs, not otherwise provided for, one hundred per centum ad valorem.
"Provided, That imported eggs, fresh or preserved, in natural form, shall be plainly marked with cancelling ink, on the shell of every egg, thus: 'IMPORTED'."
SECTION 4. The Secretary of Finance shall from time to time investigate the meat, lard and egg markets in the Philippine Islands, and, whenever in his judgment conditions warrant it, recommend to the Governor-General the reduction or increase of the rates herein specified. The Governor-General, upon recommendation of the Secretary of Finance, may, by proclamation, reduce the rates on each or all of the articles enumerated herein to a sum not less than three dollars on articles enumerated under paragraph two hundred and two above; not less than three dollars on articles enumerated under paragraph two hundred and five above; and not less than five dollars on articles enumerated in subsection (a), paragraph two hundred and sixty-nine above, or increase such rates back to the amounts in this Act set forth.
SECTION 5. When this Act shall have been approved, expressly or impliedly, by the President of the United States of America, as provided in section ten of the Act of Congress of August twenty-ninth, nineteen hundred and sixteen, entitled "An Act to declare the purpose of the people of the United States as to the future political status of the people of the Philippine Islands and to provide a more autonomous government for those Islands", such fact shall be made known by proclamation by the Governor-General of the Philippine Islands, and this Act shall take effect on the date of such proclamation. 1
