ACT NO. 3954
AN ACT TO AMEND THE FIRST PARAGRAPH OF SECTION ONE, AND SECTION SEVEN OF ACT NUMBERED THREE THOUSAND TWO HUNDRED AND TWO, KNOWN AS THE TRADE-MARK LAW FOR CIGARS AND CIGARETTES, AND FOR OTHER PURPOSES
SECTION 1. The first paragraph of section one of Act Numbered Three thousand two hundred and two, known as the "Trade-mark Law for Cigars and Cigarettes", is hereby amended to read as follows:
"SEC. 1. With the exception of trade-marks and trade-names already registered under the provisions of Act Numbered Six hundred and sixty-six, as amended, no trade-mark or trade-name shall be used on cigars and cigarettes in the Philippine Islands without having first been registered in the Bureau of Commerce and Industry, in accordance with the provisions of this Act and upon compliance with the requisites, as regards the application, prescribed in the Trade-mark Law, Act Numbered Six hundred and sixty-six, as amended: Provided, That the Director of the Bureau of Commerce and Industry may, upon payment by the applicant of a fee of ten pesos, issue a special permit to said applicant to use his trade-mark or trade-name, during the pendency of its registration in his office: Provided, further, That such special permit shall be granted only after examination of the trade-mark or trade-name applied for, and when it is found out that it is not identical with or similar to a trade-mark or trade-name already registered in his office."
SECTION 2. Section seven of said Act Numbered Three thousand two hundred and two is hereby amended so as to read as follows:
"SEC. 7. Any person, firm or corporation using a trade-mark or trade-name for cigars or cigarettes without first having complied with the provisions of this Act, shall be punished by a fine of not less than two hundred pesos nor more than one thousand pesos, or by imprisonment for not less than ninety days nor more than one year, or both, in the discretion of the court."
SECTION 3. This Act shall take effect on its approval.
