REPUBLIC ACT NO. 5779
AN ACT AMENDING SECTION NINETY-TWO OF THE REVISED CHARTER OF THE CITY OF CEBU
SECTION 1. Section ninety-two of Republic Act Numbered Thirty-eight hundred fifty-seven, known as the Revised Charter of the City of Cebu, is amended to read as follows:
"SEC. 92. Powers and duties of the Chief of Fire Department. — There shall be a Chief of Fire Department with a salary of not less than fifteen thousand two hundred pesosper annum who shall have the management and control of all matters relating to the administration of said department, and the organization, discipline, and disposition of the fire force; shall have charge of fire engine houses, fire engines, hose carts, hooks and ladders, trucks, and all other fire apparatus; shall have full police powers in the vicinity of fires; shall have authority to remove any building or other property whenever it shall become necessary to prevent the spreading of fire or to protect adjacent property; shall issue subpoena, investigate the report to the Mayor upon the origin and cause of all fires occurring within the city and if such fire is criminally caused, shall refer the matter to the city fiscal's office for immediate prosecution notwithstanding any law to the contrary; shall inspect all buildings erected or under construction or repair within the city and determine whether they provide sufficient protection against fire and comply with the ordinance relating thereto; shall have charge of the city telegraph, telephone, city streetlight service and fire alarm service; shall supervise and regulate the stringing, grounding and installation of wires for all electrical connections, including the use of electric meters, electric generators, electrically powered appliances, with a view to avoiding conflagrations, interference with public traffic and public safety, or the necessary operations of the fire department; shall supervise and regulate the maintenance, storage, and use of petroleum, gas, acetylene, gunpowder and other highly combustible matter and explosives; and shall see that all ordinances relating to those subjects or any of them, are enforced. The Chief of the Fire Department shall have an assistant and such other personnel to assist him in his duties as may be provided from time to time by appropriation ordinances." cd
SECTION 2. This Act shall take effect upon its approval.
