Amendment to R.A. No. 9165 (Anti-Drug Campaign of the Government)
Republic Act No. 10640, enacted on July 15, 2014, amends Section 21 of the Comprehensive Dangerous Drugs Act of 2002 to strengthen the government's anti-drug campaign. It mandates the Philippine Drug Enforcement Agency (PDEA) to take charge of confiscated dangerous drugs and related materials, requiring a physical inventory and photographic documentation in the presence of the accused and other officials immediately after seizure. If compliance with these requirements is not feasible, the validity of the seizure remains intact as long as the integrity of the items is preserved. The PDEA is tasked with issuing implementing rules and regulations in consultation with the Department of Justice to effectively curb drug-related offenses. The law takes effect 15 days after publication in two newspapers of general circulation.
