EXECUTIVE ORDER NO. 662-B
AMENDING SECTION SEVEN OF EXECUTIVE ORDER NO. 662 (SERIES OF 2007) ENTITLED ENHANCING TRANSPARENCY MEASURES UNDER REPUBLIC ACT NO. 9184 AND CREATING THE PROCUREMENT TRANSPARENCY BOARD
WHEREAS, Executive Order No. 662 (series of 2007) created the Procurement Transparency Group to monitor compliance to anti-graft mechanisms, to deter anomalies in the awarding of public sector contracts and to prevent losses due to procurement irregularities; ACcEHI
WHEREAS, Section 7 of Executive Order No. 662 directs the Procurement Transparency Group to recommend to the Presidential Anti-Graft Commission the imposition of sanctions, implementation of remedial measures and the filing of criminal, civil and/or administrative charges and provide information for actions that may be taken on its recommendations;
WHEREAS, there is a need to simplify the legal process in the determination and implementation of sanctions and the filing of criminal, civil and/or administrative charges against those that violate the directives of Republic Act 9184 of the Government Procurement Reform Act and Executive Order 662 (series of 2007);
WHEREAS, Section 17, Article VII of the Constitution provides that the President shall have control of all executive departments, bureaus and offices and shall ensure that all laws be faithfully executed;
NOW, THEREFORE, I, GLORIA MACAPAGAL-ARROYO, President of the Republic of the Philippines, by virtue of the powers vested in me by law, do hereby order:
SECTION 1. Amendment. — Section 7 of Executive Order No. 662 dated September 20, 2007 is hereby further amended to read as follows:
"Section 7. Upon findings of non-compliance with the foregoing directives, the Group shall recommend to the Office of the Ombudsman the filing of criminal, civil and/or administrative charges." SHacCD
SECTION 2. Repealing Clause. — All executive issuances inconsistent with this Executive Order are hereby repealed or amended accordingly.
SECTION 3. Effectivity. — This Executive Order shall take effect immediately. THcEaS
