CHED MEMORANDUM ORDER NO. 08-07
| SUBJECT | : | Amendments to CHED Memorandum Order (CMO) No. 38 S. 2006 Entitled "Procedures in the Processing of Applications for the Grant of Authority to Operate Ladderized Programs as Part of the Implementation of Executive Order No. 358, Entitled "to Institutionalize a Ladderized Interface Between Technical-Vocational Education and Training (TVET) and Higher Education (HE)" |
In accordance with the pertinent provisions of Republic Act (RA) 7722, otherwise known as the "Higher Education Act of 1994," the Commission on Higher Education hereby promulgates the following amendments to CMO No. 38 S. 2006 in order to streamline the processing of applications for the grant of authority to operate ladderized baccalaureate programs.
1. Item A. of No. 1 on the Procedures in the Processing of Applications for the Grant of Authority to Operate Ladderized Baccalaureate programs is hereby amended as follows:
A. For Higher Education Institutions with existing straight/traditional baccalaureate programs
THE ISSUANCE OF A CERTIFICATE OF RECOGNITION SHALL BE PROCESSED AS FOLLOWS:
1. SUBMISSION OF APPLICATION
THE APPLICATION FOR THE GRANT OF "CERTIFICATE OF AUTHORITY" TO OPERATE THE LADDERIZED BACCALAUREATE PROGRAM SHALL BE SUBMITTED TO THE CONCERNED COMMISSION ON HIGHER EDUCATION REGIONAL OFFICE ATTACHING THEREWITH THE DULY CERTIFIED GOVERNMENT AUTHORITY TO OPERATE THE BACCALAUREATE PROGRAM OR THE BOARD RESOLUTION OF THE GOVERNING BOARDS OF THE APPLICANT SUC OR LUC APPROVING THE OPENING OF THE BACCALAUREATE PROGRAM.
THE APPLICANT HEI SHALL NOT BE CHARGED ANY FILING FEE NOR BE REQUIRED TO POST A BOND FOR SUCH APPLICATION.
2. EVALUATION OF THE PROPOSED LADDERIZED CURRICULA
2.1. IN THE EVENT THAT THE PROGRAM BEING APPLIED FOR LADDERIZATION HAS NO EXISTING MODEL CURRICULUM, THE APPLICATION SHALL BE IMMEDIATELY REFERRED TO THE PERMANENT TECHNICAL SECRETARIAT OF THE LADDERIZATION PROGRAM AT THE CHED CENTRAL OFFICE FOR FURTHER EVALUATION BY THE CHED AND TESDA TECHNICAL WORKING GROUP OF THE PROPOSED EMBEDDED LADDERIZED CURRICULUM.
HOWEVER, EVEN PENDING EVALUATION OF THE EMBEDDED LADDERIZED CURRICULUM CONSIDERED UNDER THIS SECTION, THE CHEDRO SHALL STILL ENDORSE THE APPLICATION TO THE TESDA REGIONAL OFFICE FOR FURTHER EVALUATION AND ISSUANCE OF CoPR.
2.2. FOR PROGRAMS THAT HAVE EXISTING MODEL CURRICULA, UPON RECEIPT OF SAID APPLICATION THE CHEDRO SHALL IMMEDIATELY REFER THE SAME TO THE TESDA REGIONAL OFFICE FOR FURTHER EVALUATION AND THE ISSUANCE OF THE CoPR FOR THE TVET QUALIFICATIONS EMBEDDED IN THE PROPOSED LADDERIZED CURRICULUM. TESDA SHALL ISSUE CoPR WHEN THE PROGRAM COMPLIES WITH THE REQUIREMENTS OF FULL NATIONAL CERTIFICATE (NC) QUALIFICATION IN LINE WITH THE TRAINING REGULATIONS PROMULGATED BY TESDA. THE PROGRAM REGISTRATION SHALL BE IN LINE WITH THE UNIFIED TVET PROGRAM REGISTRATION AND ACCREDITATION SYSTEM (UPTRAS). DCSTAH
3. ISSUANCE CERTIFICATE OF AUTHORITY
UPON ISSUANCE OF CoPR, THE TESDA REGIONAL OFFICE SHALL REFER BACK TO CHEDRO THE APPLICATION INCLUDING THE CoPR.
THE CHEDRO SHALL THEN ISSUE THE CERTIFICATE OF AUTHORITY WHEN THE PROPOSED LADDERIZED CURRICULUM COMPLIES WITH THE CHED'S CURRICULAR REQUIREMENTS.
THE RECOGNITION OF THE EXISTING TRADITIONAL PROGRAM WILL BE USED IN THE ISSUANCE OF SPECIAL ORDER (S.O.) NUMBERS FOR THE GRADUATING STUDENTS OF THE LADDERIZED BACCALAUREATE PROGRAMS.
2. Item B of No. 1 on HEIs that will offer the new baccalaureate degree program under the ladderized system is hereby amended to include the following paragraph thereby:

IN CASE THE INTENDED NEW BACCALAUREATE DEGREE PROGRAM UNDER THE LADDERIZED SYSTEM BEING APPLIED FOR HAS NO EXISTING MODEL CURRICULUM, THE APPLICATION SHALL BE IMMEDIATELY REFERRED TO THE PERMANENT TECHNICAL SECRETARIAT OF THE LADDERIZATION PROGRAM AT THE CHED CENTRAL OFFICE FOR FURTHER EVALUATION BY THE CHED AND TESDA TECHNICAL WORKING GROUP OF THE PROPOSED EMBEDDED LADDERIZED CURRICULUM.
HOWEVER, EVEN PENDING EVALUATION OF THE EMBEDDED LADDERIZED CURRICULUM CONSIDERED UNDER THIS SECTION, THE CHEDRO SHALL STILL ENDORSE THE APPLICATION TO THE TESDA REGIONAL OFFICE FOR FURTHER EVALUATION AND ISSUANCE OF CoPR, IF QUALIFIED.
3. In Item II on Model Ladderized Curricula, the third paragraph is hereby amended as follows:
THESE PROCEDURES SHALL APPLY TO ALL HEIS INCLUDING THE AUTONOMOUS AND DEREGULATED HIGHER EDUCATION INSTITUTIONS IN CASE OF STATE UNIVERSITIES AND COLLEGES (SUCS) AND LOCAL COLLEGES AND UNIVERSITIES (LCUS), THE ABOVE PROCEDURES SHALL BE FOLLOWED PRIOR TO ANY ACTION BY THE GOVERNING BOARDS ON THE OPENING OF THE LADDERIZED PROGRAM. THE FINDINGS AND EVALUATION OF THE CHED AND TESDA, INCLUDING THE CHED-TESDA TECHNICAL WORKING GROUP IF NECESSARY FOR PROGRAMS WITHOUT ANY EXISTING MODEL LADDERIZED CURRICULA, SHALL BE FORWARDED TO THE RESPECTIVE GOVERNING BOARDS WHICH SHALL ACT IN ACCORDANCE WITH THE SAID FINDINGS AND EVALUATION.
4. A new Item, Item III is hereby included allowing the partnership between HEI and a Technical Vocational Institution (TVI) to jointly operate an embedded ladderized degree program, to be as follows:
ITEM III. JOINT OPERATION BY AN HEI AND TVET SCHOOL OF EMBEDDED LADDERIZED DEGREE PROGRAMS
NOTHING IN THIS CMO PROHIBITS THE ACCEPTANCE AND PROCESSING OF APPLICATIONS BY AN HEI AND A TVI JOINTLY OPERATE EMBEDDED LADDERIZED DEGREE PROGRAMS. IN SUCH CASES, THE APPLICANT HEI SHALL LIKEWISE SUBMIT FOR EVALUATION, ALONG WITH THE OTHER DOCUMENTS REQUIRED UNDER THIS CMO, THE MEMORANDUM OF AGREEMENT WITH A TVI WITH DULY ISSUED CoPR ON THE TVET PROGRAM SOUGHT TO BE LADDERIZED DETAILING THEIR RESPECTIVE OBLIGATIONS AND RESPONSIBILITIES IN THE JOINT OPERATION OF THE PERTINENT EMBEDDED LADDERIZED PROGRAM/S.
4. All existing issuances inconsistent herewith are hereby deemed revoked, revised, amended and/or repealed accordingly.
5. This CMO shall take effect fifteen (15) days after publication in the Official Gazette or a newspaper of general circulation.
