Amendment to Article V, Sections 5 and 12 of CMO No. 32, Series of 2006

In accordance with the pertinent provisions of the Republic Act No. 7722, otherwise known as the Higher Education Act of 1994, and pursuant to Commission En Banc (CEB) Resolution No. 453-2016, adopted during the 2nd National Directorate Meeting held on June 21, 2016, the provisions on Article V, Sections 5 and 12 of CMO No. 32, Series of 2006 are hereby amended as follows: AcICHD
SECTION 5. The Governing Board of the College or Dalubhasaan shall be its Board of Trustees, with the following composition: Chairman, Local Chief Executive; Vice Chairman, President of the College, and six (6) members composed of, but not limited to, President of the Faculty Association, President of the Supreme Student Council/Government, President of the Alumni Association, Chairman of the Sanggunian Committee on Education, Representative from the Association of Local Colleges and Universities (ALCU) and Representative from the Accredited Business or Industry Sector. The representatives of the faculty, student body and alumni are co-terminus with their respective terms of office. The representative from the accredited business or industry sector shall be appointed by the Board for a specific term. The representative from the ALCU shall be appointed by the Board for a specific term subject to confirmation of the President of National ALCU. The CHED Regional Director or his/her duly designated representative may be invited as a resource person during board meetings.
SECTION 12. The Governing Board of the University or Pamantasan shall be its Board of Regents (BOR) which shall be composed of the following: Chairman, Local Chief Executive; Vice Chairman, President of the University; and eight (8) members composed of, but not limited to, the President of Faculty Association, President of the Supreme Student Council/Government, President of the Alumni Association, Chairman of the Sanggunian Committee on Education, two (2) representatives from the accredited Non-Government Organizations (NGOs), preferably from business industry sector, representative from ALCU, and representative from the Department of Science and Technology (DOST). The representatives of the faculty, student body and Alumni are co-terminus with their respective terms of office. The representatives from the NGOs shall be appointed by the Board for a specific term. The representative from the ALCU shall be appointed by the Board for a specific term subject to confirmation of the President of National ALCU. The representative from the Department of Science and Technology (DOST) who shall hold a rank not lower than Director shall be appointed by the Board for a specific term subject to the confirmation of the Secretary of DOST. The CHED Regional Director or his/her duly designated representative may be invited as a resource person during board meetings.
All other provisions in CMO No. 32, s. 2006 and its implementing rules and regulations stated in CMO No. 04, s. 2007 not inconsistent herewith shall remain in force and effect.
This CMO containing above amendments shall take effect immediately upon its publication in a newspaper of general circulation and remain in force unless otherwise revoked or modified accordingly.
