Amendment to Article 125 of Act No. 3815 (Revised Penal Code)

Act No. 3940, enacted on November 29, 1932, amends Article 125 of the Revised Penal Code to extend the legal detention period for individuals before they must be delivered to judicial authorities. Specifically, it imposes penalties on public officers who fail to transfer detained persons to the proper authorities within six hours. This act also repeals any conflicting laws and takes effect upon approval.

ACT NO. 3940

AN ACT TO EXTEND THE PERIOD OF LEGAL DETENTION OF A PERSON BEFORE HIS DELIVERY TO THE JUDICIAL AUTHORITIES, AMENDING THE REVISED PENAL CODE ACCORDINGLY

SECTION 1. Article one hundred and twenty-five of Act Numbered Thirty-eight hundred and fifteen, known as the Revised Penal Code, is hereby amended to read as follows:

ART. 125. Delay in the delivery of detained persons to the proper judicial authorities. — The penalties provided in the next preceding article shall be imposed upon the public officer or employee who shall detain any person for some legal ground and shall fail to deliver such person to the proper judicial authorities within the period of six hours."

SECTION 2. All acts or parts of acts inconsistent herewith are hereby repealed.

SECTION 3. This Act shall take effect on its approval.
