Amendment of the List of Less Developed Areas (LDAs) under Annex "A" of the 2014 Investment Priorities Plan (IPP)

BOI MEMORANDUM CIRCULAR NO. 2016-003

 

WHEREAS, Memorandum Order No. 74 Approving the 2014 Investments Priorities Plan was signed by the President on 28 October 2014, and its General Policies and Specific Guidelines were published in the 06 April 2015 issue of the Philippine Star;

WHEREAS, the 2014 IPP contains a list of Less Developed Areas (LDAs), which is determined taking into consideration the following criteria: low per capita gross domestic product; low level of investments; high rate of unemployment and/or underemployment; and low level of infrastructure development including its accessibility to develop urban centers pursuant to Article 40 of Executive Order (E.O.) No. 226, otherwise known as the Omnibus Investments Code of 1987, as amended;

WHEREAS, Article 40 of E.O. 226 provides that registered projects located in identified LDAs shall be entitled to pioneer incentives and additional deduction from taxable income equivalent to 100% of expenses incurred in the development of necessary and major infrastructure facilities unless otherwise specified in the IPP's specific guidelines;

WHEREAS, in line with the Administration's strategy to move into the medium to long term recovery and rehabilitation of areas highly affected by calamities, the Board has approved the inclusion of one hundred thirty four (134) cities/municipalities in the list of the LDAs of the 2014 IPP.

NOW THEREFORE, in order to effectively carry out the intent and purposes of E.O. 226, the Board, in its meeting of 13 July 2016, by virtue of Board Resolution No. 19-02, Series of 2016, with a quorum duly present, approved the inclusion/addition of the calamity stricken cities/municipalities in the List of LDAs under Annex "A" of the 2014 IPP, as follows:

This Circular shall take effect immediately upon publication in a newspaper of general circulation and three (3) copies thereof shall be filed with the Office of the National Administrative Register (ONAR), University of the Philippines (UP) Law Center, Diliman, Quezon City pursuant to Presidential Memorandum Circular No. 11 dated 09 October 1992.
