Additionally, the order mandates GEPCSET to provide technical assistance to government agencies and recommend improvements to government policies related to electronic payment systems. DTI JOINT DEPARTMENT ADMINISTRATIVE ORDER NO. 10-03

SUBJECT : Amendment of JDAO No. 02, Series 2006, as Amended Otherwise Known as Guidelines Implementing R.A. 8792 on Electronic Payment and Collection Systems (EPCS) in Government

 

WHEREAS, under Article VIII (F) of JDAO No. 02, series 2006, the Department of Finance (DOF) and Department of Trade and Industry (DTI) shall request Congress to allocate Five Million Pesos from the E-Government Fund (E-Gov Fund) as seed fund for the initial operation, training and acquisition of supplies and equipment of the GEPCSET;

WHEREAS, for FY 2006-2008, GEPCSET secured funding for its operations from the E-Gov Fund;

WHEREAS, pursuant to JDAO No. 09-02, series of 2009, DOF included in its annual budget the financial requirements of GEPCSET for FY 2009-2010 until such time that the DOF shall have assumed the GEPCSET functions pursuant to JDAO No. 02, series of 2006;

WHEREAS, to facilitate its effective operation, GEPCSET requires regular budget allocation from the General Appropriations Act and entitlement from the E-Gov Fund in accordance with existing applicable rules and regulations of the Department of Budget and Management (DBM) and the Commission on Information and Communications Technology (CICT), respectively;

WHEREAS, to align its functions and mandate in promoting the adoption of an end-to-end electronic payment and collection systems for National Government Agencies, there is a need to lodge and allocate the budget of GEPCSET with the government agency overseeing the implementation of the National Collection System; CSHEca

WHEREAS, the Bureau of the Treasury (BTr) is the agency of the government mandated to implement the National Collection System and performs cash management of the financial resources of the government;

WHEREAS, there is a further need to enhance the mandate of GEPCSET to include information dissemination and policy recommendation to improve government policies on the use of electronic payment and collection systems for fees, charges and assessments due to National Government Agencies which are required by law to be remitted to the National Treasury for credit of the General Fund of the government;

NOW, THEREFORE, this Order is promulgated as follows:

SECTION 1. Section 4, JDAO No. 09-02, amending JDAO No. 02, series 2006 and JDO No. 01, series 2007, is further amended to read as follows:

SECTION 4. Budget. — The DOF, through the Bureau of the Treasury (BTr), shall include in its annual budget the financial requirements for the operation of GEPCSET until such time that DOF shall have assumed the GEPCSET functions pursuant to JDAO No. 02, series 2006, as amended by JDAO No. 09-02, series 2009.

SECTION 2. Article VIII of JDAO No. 02, series 2006 is further amended by adding a new letter (G), as follows:

G. The GEPCSET shall assist the Department of Trade and Industry in ensuring continuous public awareness on government policies and the benefits of electronic commerce for government. For this purpose, the GEPCSET shall conduct information dissemination and advocacy programs on government electronic payment and collection policies and the benefits of implementing electronic payment and collection systems in government; provide, where warranted, technical assistance to government agencies and instrumentalities on compliance with Section 27 of RA 8792 and Section 37 of its Implementing Rules and Regulations as implemented by JDAO No. 02, series of 2006, as amended; and, study and recommend improvement of government policies on the use of electronic payment and collection systems for the collection and remittance of fees, charges and assessments due to National Government Agencies which are required by law to be remitted to the National Treasury for credit of the General Fund of the government.

SECTION 3. Subject to such rules and regulations promulgated by CICT, GEPCSET shall submit an application for entitlement to the E-Gov Fund such as, but not limited to, projects and activities on electronic payment and collection systems in government implemented by GEPCSET or in coordination with government agencies and instrumentalities. SECTION 4. This Order shall take effect fifteen (15) days after publication in the Official Gazette or in two (2) newspapers of general circulation.
