Amending Section 6, Par. (C.2) of the Implementing Rules and Regulations of R.A. 9207, S. 2003 on the Role of the National Housing Authority

NGCAC RESOLUTION NO. 003-12

AMENDING SECTION 6, PAR. (C.2) OF THE IMPLEMENTING RULES AND REGULATIONS OF R.A. 9207, S. 2003 ON THE ROLE OF THE NATIONAL HOUSING AUTHORITY

WHEREAS, pursuant to Section 9 of R.A. 9207, s. 2003, otherwise known as "The National Government Center Housing and Land Utilization Act of 2003," the NGCAC was directed to enact the Implementing Rules and Regulations of the abovementioned law.

WHEREAS, in Section 6, "The Administration Committee" of the Implementing Rules and Regulations of R.A. 9207, s. 2003, it defined the roles of each member agency of the Administration Committee.

WHEREAS, in par. c.2 and c.4 of the said IRR, it enumerated the specific roles of NHA and DPWH respectively.

WHEREAS, the major issues in the implementation and/or completion of the project are the problems of unacquired properties and reconstitution of lost and destroyed titles.

WHEREAS, the said activities are lodged with the DPWH pursuant to par. c.4 of the abovementioned IRR.

WHEREAS, there is a need to help the DPWH in performing their function as mandated in the IRR for the same is not their main and/or core function.

WHEREAS, the NHA as the Project Trustee and the Administrator of the NGC Housing Projects can assist the DPWH with regards to the acquisition of unacquired properties and the filing of reconstitution cases of lost and or destroyed titles of NGC.

WHEREAS, there is a need to amend Par. (c.2) of Section 6 of the IRR in order for NHA to effectively help DPWH with the abovementioned issues.

NOW, THEREFORE, on motion duly seconded, RESOLVED AS IT IS HEREBY RESOLVED, to amend Par. (c.2) of Section 6 of the IRR of R.A. 9207, s. 2003, to read as follows:

Section 6. The NGC Administrative Committee. —

c. Functions of the members of the NGC-AC.

(c.2) NHA shall:

(i) Serve as the trustee of the project;

 As such it shall serve as the fund manager of the project trust fund, custodian of titles to the properties within the NGC project and manager of institution and commercial establishments.

(ii) Provide technical assistance to the project in the area of estate management.

(iii) Undertake the acquisition of the unacquired properties within the NGC project site.

(iv) Undertake the reconstitution of lost and/or destroyed titles to properties within the NGC Project.

(v) Serve as ARAC member.
