Amending Rule 9 Section 2 (C) of the Bureau of Immigration Omnibus Rules of Procedure of 2015
BI Memorandum Circular No. JHM-2018-002, issued on March 26, 2018, amends Rule 9 Section 2 (c) of the Bureau of Immigration's Omnibus Rules of Procedure. It clarifies the definition of a "fugitive from justice" as a foreign national designated by a foreign embassy or the International Police, or whose passport has been canceled by their embassy/consulate. The amendment addresses delays in passport cancellations that hinder deportation orders and result in the prolonged detention of fugitives, exacerbating congestion in the Bureau of Immigration Warden's Facility. The new rules are effective immediately upon publication, with all conflicting issuances repealed or modified accordingly.
