Amending NAPOLCOM Resolution No. 2010-145, Entitled: "Revised Guidelines and Procedures on the Detail of Philippine National Police (PNP) Uniformed Personnel to Other Government Offices/Agencies"
On April 6, 2016, the National Police Commission (NAPOLCOM) amended its previous resolution regarding the promotion of Philippine National Police (PNP) uniformed personnel detailed to other government offices. The amendment allows detailed Police Non-Commissioned Officers to be considered for promotion without being recalled to their original units, provided they meet the minimum qualifications and their functions relate to law enforcement. Police Commissioned Officers on detail can also be placed in vacant positions within the PNP, and personnel on UN missions are eligible for promotion with favorable endorsements. The revised guidelines aim to ensure equal opportunities for career advancement among police officers performing essential law enforcement functions outside of the PNP. The resolution took effect 15 days after its filing.

AMENDING NAPOLCOM RESOLUTION NO. 2010-145, ENTITLED: "REVISED GUIDELINES AND PROCEDURES ON THE DETAIL OF PHILIPPINE NATIONAL POLICE (PNP) UNIFORMED PERSONNEL TO OTHER GOVERNMENT OFFICES/AGENCIES"
WHEREAS, the Constitution and Section 14 of Republic Act No. 6975, as amended, provides that the National Police Commission (NAPOLCOM) shall exercise administrative control and operational supervision over the Philippine National Police (PNP);
WHEREAS, the Commission issued Resolution No. 2010-145, entitled: "Revised Guidelines and Procedures on the Detail of Philippine National Police (PNP) Uniformed Personnel to Other Government Offices/Agencies";
WHEREAS, Section II (g) (4) and (5) thereof provide the guidelines on the promotion of detailed PNP Uniformed Personnel:
"II. POLICY GUIDELINES
g. The administrative jurisdiction of the PNP and the receiving office or agency over detailed PNP uniformed personnel shall be as follows: aScITE

4. Promotion of Detailed PNP Uniformed Personnel:
a. PNP uniformed personnel on detail outside the DILG shall not be considered for promotion during the period of his/her detail and within six (6) months from the termination of their detail.
b. However, personnel on detail with the offices/agencies under the DILG may be extended promotion subject to existing policies and procedures. Provided, that there is an existing vacant position within the PNP: Provided, further, that 3rd level PCOs who are on detail and have assumed similar key positions for at least one (1) year shall be deemed to have occupied a table of organization (TO) position for star rank position in the PNP upon termination of the detail.
c. PNP personnel who are due for promotion presently on detail outside the PNP shall be recalled at least one (1) year before the start of processing of promotion and shall be assigned to positions commensurate to their rank. They shall be replaced by equally qualified personnel provided they are not due for promotion in the next two (2) years.
5. PNP Uniformed Personnel detailed outside the PNP which shall be carried by the PHAU and those detailed for UN mission shall be qualified for promotion on the condition that they are favorably endorsed by their respective contingent heads thru the Directorate for Plans.

WHEREAS, it has come to the attention of the Commission the need to review the existing policy on the promotion of detailed PNP uniformed personnel, specifically on the restrictions and conditions imposed on those who are on detail outside the Department of the Interior and Local Government (DILG), but are actually performing functions related to law enforcement;
WHEREAS, the Commission, after consideration of said policy, has recognized the need to amend the same in order to provide equal opportunity for the career advancement of police officers who, despite being on detail outside the DILG and the PNP, are essentially performing functions which are of equal importance for the maintenance of peace, security and order in the country;
NOW, THEREFORE, the Commission in the exercise of its Constitutional mandate to administer and control the PNP, HAS RESOLVED TO AMEND, AS IT HEREBY AMENDS, NAPOLCOM Resolution No. 2010-145, specifically Section II (g) (4) and (5) thereof, to read as follows:
"II. POLICY GUIDELINES
g. The administrative jurisdiction of the PNP and the receiving office or agency over detailed PNP uniformed personnel shall be as follows:

4. Placement and Promotion of Detailed PNP Uniformed Personnel:
a. Police Non-Commissioned Officers personnel on detail outside the PNP, who meets the minimum qualifications for promotion, shall be considered for promotion without need of being recalled to his/her unit of appointment.
Once promoted, the concerned PNP uniformed personnel may continue on detail in the same receiving Office provided that the designation is commensurate to the rank and the functions are related to law enforcement. Provided, further, that continuance of detail shall be subject to the discretion of the head of unit of appointment, with its personnel requirement as primary consideration.
b. Police Commissioned Officers (PCOs) who are on detail outside the PNP shall be considered for placement to vacant table of organization (TO) positions in the PNP: Provided, that they meet the minimum qualification standards and mandatory requirements under existing policies and procedures for such position.
c. PNP uniformed personnel who are on detail with UN missions shall be considered for promotion on the condition that they are qualified and favorably endorsed by their respective Contingent Heads thru the Directorate for Plans.
5. PNP uniformed personnel detailed outside the PNP shall be carried in the PHAU roster of personnel.

All other issuances inconsistent with the provisions of this Resolution are hereby deemed rescinded or modified accordingly.
This Resolution shall take effect fifteen (15) days from the filing of a copy hereof at the University of the Philippine Law Center, in consonance with Sections 3 and 4 of Chapter 2, Book VII of Executive Order No. 292, otherwise known as "The Revised Administrative Code of 1987," as amended.
