Adoption of ICAO Annex 6 Part 1 Amendment 39 to PCAR Parts 1, 8 and 9
The CAAP Memorandum Circular No. 043-16, issued on December 22, 2016, approves the incorporation of amendments to the Philippine Civil Aviation Regulations (PCAR) Parts 1, 8, and 9, aligning them with ICAO Annex 6 Part 1 Amendment 39. Key amendments include the establishment of mandatory aircraft tracking capabilities for operators, requiring position updates at standardized intervals, particularly for larger aircraft. The circular also defines terms related to search and rescue operations and stipulates the retention of tracking data to support these operations. Pursuant to the powers vested in me under Republic Act 9497, otherwise known as the Civil Aviation Authority Act of 2008 and in accordance with the Regulations Amendment Procedures with Board Resolution No.: 2012-054 dated 28 September 2013, I hereby approve the incorporation of amendments to the Philippine Civil Aviation Regulations Parts 1, 8 and 9.

APPENDIX A DEFINITIONS
Aircraft tracking.
A process, established by the operator, that maintains and updates, at standardized intervals, a ground-based record of the four dimensional position of individual aircraft in flight.

8.1.1.2 DEFINITIONS

(b) When the following terms are used in this Part and definitions for the operation of airplanes and helicopters in, they have the following meanings:
(10) Aircraft tracking.
A process, established by the operator, that maintains and updates, at standardized intervals, a ground-based record of the four dimensional position of individual aircraft in flight.

(134) Rescue. An operation to retrieve persons in distress, provide for their initial medical or other needs, and deliver them to a place of safety.

(140) Search.
An operation normally coordinated by a rescue coordination centre or rescue subcentre using available personnel and facilities to locate persons in distress.

8.2.2 [AOC] AIRCRAFT TRACKING
(a) On and after 8 November 2018, an Operator shall establish an aircraft tracking capability to track airplanes throughout its area of operations.
Note. — Guidance on aircraft tracking capabilities is contained in the Normal Aircraft Tracking Implementation Guidelines (Cir 347)
(b) An Operator shall track the position of an airplane through automated reporting at least every 15 minutes for the portion(s) of the inflight operation(s) under the following conditions:
(1) the airplane has a maximum certificated take-off mass of over 45 500kg and a seating capacity greater than 19; and
(2) where an ATS unit obtains airplane position information at greater than 15 minute intervals.
Note 1. — Oceanic area- for the purpose of aircraft tracking is the airspace which overlies waters outside the territory of the Philippines.
Note 2. — See CAR-ANS Part 11.2 for coordination between the operator and air traffic services provisions regarding position report messages.
(c) An Operator should track the position of an airplane through automated reporting at least every 15 minutes for the portion(s) of the inflight operation(s) that is planned in an oceanic area(s) under the following conditions:
(1) the airplane has a maximum certificated take-off mass of over 27 000 kg and a seating capacity greater than 19; and
(2) where an ATS unit obtains airplane position information at greater than 15 minutes intervals.

(d) An Operator shall establish procedures, approved by the Authority, for the retention of aircraft tracking data to assist SAR in determining the last known position of the aircraft.
Note. — Refer to PCAR Part 9.1.1.4 for operator responsibilities when using third parties for the conduct of aircraft tracking under PCAR
8.12.1.4 OPERATIONAL CONTROL DUTIES
(a) A flight operations officer/flight dispatcher in conjunction with a method of control and supervision of flight operations in accordance with Subpart 9.1.1.6 (c) shall:

5) notify the appropriate ATS unit when the position of the airplane cannot be determined by an aircraft tracking capability and attempts to establish communication are unsuccessful.

9.1.1.4 COMPLIANCE WITH AN AIR OPERATOR CERTIFICATE

(b) An operator shall develop policies and procedures for third parties that perform work on its behalf.
EFFECTIVITY:
Fifteen (15) days after compliance with the requisite publication in a single newspaper of general circulation and a copy filed with the U.P. Law Center-Office of the National Administrative Register, these amendments shall be incorporated to the Philippine CAR Parts 1, 8 and 9, series of 2016 and shall supersede any memoranda, regulations and directives in conflict herewith.
