OCA CIRCULAR NO. 68-09

SUBJECT : Adopting an Ecological Solid Waste Management System in the First and Second Level Courts and Creating a Task Force for the Purpose

 

To attain the policy of the State to protect and promote the right to health of the people and instill health consciousness among them (Section 15, Article II of the Constitution), Republic Act No. 9003, otherwise known as The Ecological Solid Waste Management Act of 2000, was enacted to ensure the protection of public health and environment in general and to institutionalize public participation in the development and implementation of national and local integrated, comprehensive, and ecological waste management programs. In Administrative Circular 46-2003 dated 18 September 2003 re: Adopting an Ecological Solid Waste Management System and Creating a Task Force for the Purpose, the Court acknowledges the role of the National Solid Waste Management Commission (NSWMC) in overseeing the implementation of solid waste management plans, prescribing policies to achieve the objectives of R.A. No. 9003, taking the lead in the implementation of the Act in all government agencies and in requiring said agencies to adopt an ecological waste management system to be disseminated to all employees.

In the same Administrative Circular then Honorable Chief Justice Hilario G. Davide, Jr., formed a Task Force to formulate a comprehensive action plan for the Court composed of the Chief Administrative Officer; Supervisory Staff representing the different offices of the Court, Representatives of the employees associations; The Head of the Maintenance Division; and The Head of the Contracted Janitorial Services.

The Task Force was mandated to adopt an ecological waste management plan and to coordinate with the NSWMC for technical assistance to implement waste segregation in the Court in order to achieve the objectives of R.A. No. 9003.

On April 16, 2009, during the Forum on Environmental Justice — Upholding the Right to a Balanced and Healthful Ecology, a commitment was made by the Office of the Court Administrator for the replication of this undertaking in the first and second level courts.

To attain the purposes of Administrative Circular 46-2003, all judges of the first and second level courts are hereby directed to adopt an ecological solid waste management system in the court, and create a task force for the purpose. They shall oversee all the phases of the program from planning to actual implementation, monitoring, supervision, and evaluation thereof to achieve, maintain, preserve, and perpetuate at all times a pleasant environment in the court.

Executive judges shall strictly monitor compliance with this Circular by the judges under their administrative supervision, and shall submit a report on the progress of the implementation to the Court Management Office, Office of the Court Administrator within thirty days from notice. TacESD
