Administrative Order No. 02 Re: Grant of Gratuity Pay to Job Order (JO) and Contract of Service (COS) Personnel

Pursuant to Administrative Order No. 02 dated January 31, 2017 (copy attached) Re: Authorizing the Grant of Gratuity Pay to Job Order and Contract of Service Workers, particularly, all workers in the Department whose services are engaged through JO and COS and who have rendered an aggregate or a total of at least four (4) months of satisfactory service as of December 15, 2016 and whose contracts are still effective as of same date, may be granted a one-time Gratuity Pay not exceeding Two Thousand Pesos (P2,000.00) and not to exceed One Thousand Pesos (P1,000.00) for those who have rendered less than four (4) months of satisfactory service and whose contracts are still effective as of December 15, 2016, as follows:

JO/CoS Length of Service	Gratuity Pay
Total of Four (4) months as of December 15, 2016	P2,000.00 each
Less than Four (4) months as of December 15, 2016	1,000.00 each

Funds needed to cover the Gratuity Pay shall be chargeable against the respective available Maintenance and Other Operating Expenses (MOOE) allotment for the same program, activity and project (P/A/P) where the compensation of JO and COS are sourced. In case of deficiency, offices may request the DBM for additional funds (to be) charged against the identified savings generated from completed P/A/Ps, subject to approval by the President pursuant to the provisions of the General Appropriations Act (GAA) on the use of savings, and existing laws and issuances. The request to use of savings shall be submitted to the DBM for the release of Special Allotment Release Order (SARO) and Notice of Cash Allocation (NCA) for the payment of Gratuity Pay and shall be supported by: (1) Report on the number and names of JO and COS, as certified by the head of the human resource management unit and endorsed by the Secretary or head of agency; and (2) Certification from the Budget Officer that the required amount from the existing MOOE allotment is free from any obligation and may be declared as savings from completed P/A/Ps to cover funding requirements of the grant of Gratuity Pay, likewise endorsed by the Secretary or Head of Agency concerned. (Section 5 of aforementioned AO)

The Regional Offices may grant the Gratuity Pay to their eligible or qualified JO and CoS workers using funds as mentioned in the preceding paragraphs. (Sections 4 and 5 of said AO).

This Circular shall take effect immediately.
