A Resolution Approving the Proposed Amendments to the CPES Implementing Guidelines for Infrastructure Projects
On September 13, 2011, the NEDA Board Committee on Infrastructure (INFRACOM) approved amendments to the Constructors Performance Evaluation System (CPES) implementing guidelines for government infrastructure projects in the Philippines. These amendments aim to ensure compliance with the Revised Implementing Rules and Regulations of the Government Procurement Reform Act (RA No. 9184) and expand the guidelines to include new criteria for mooring facilities associated with power barges and diesel power plants. The revisions, which incorporate feedback from the INFRACOM, will take effect 15 days after publication in a leading newspaper or the Official Gazette. The updated guidelines are intended to enhance the quality and effectiveness of government infrastructure projects.

A RESOLUTION APPROVING THE PROPOSED AMENDMENTS TO THE CONSTRUCTORS PERFORMANCE EVALUATION SYSTEM (CPES) IMPLEMENTING GUIDELINES FOR INFRASTRUCTURE PROJECTS
WHEREAS, Section 12 of Annex E of the Revised Implementing Rules and Regulations (IRR) of Republic Act (RA) No. 9184, otherwise known as the Government Procurement Reform Act (GPRA), mandates all procuring entities implementing government infrastructure projects to evaluate the performance of their contractors using the NEDA-Approved CPES Guidelines for the type of project being implemented; HDICSa
WHEREAS, The CPES Guidelines cover all infrastructure projects awarded by the government regardless of contract amount and funding source;
WHEREAS, In order to ensure continuous implementation of CPES, NEDA Board Resolution No. 18, Series of 2002 (dated 10 December 2002) was issued requiring all procuring entities concerned to include in their Projects' Engineering and Administrative Overhead Cost the budget for the implementation of CPES;
WHEREAS, In order to streamline the implementation and to broaden the coverage on the type of infrastructure projects being implemented by procuring entities, the CPES Guidelines were revise on two (2) occasions, 19 May 2005 and 27 August 2008;
WHEREAS, There is a need to amend the existing CPES Guidelines to be consistent with the Revise IRR of RA No. 9184, which took effect on 02 September 2009, to include a new checklist and workmanship for mooring facilities for power barges and diesel power plants developed by the National Power Corporation (NPC), and to further enhance the effectiveness of the CPES in ensuring the quality of infrastructure projects of the government;
WHEREAS, The proposed amendments to the CPES Guidelines was formulated by the Philippine Domestic Construction Board (PDCB) and consequently endorsed by the Construction Industry Authority of the Philippines (CIAP) Board per its Resolution No. 10, Series of 2011 (dated 25 March 2011) to the INFRACOM for approval pursuant to Section 12 of Annex E of the Revised IRR of RA No. 9184;
WHEREAS, The proposed amendments to the CPES Guidelines were presented by the CIAP and PDCB to the INFRACOM in its Joint Cabinet Committee and Technical Board Meeting on 13 September 2011;
WHEREAS, The INFRACOM, during the said meeting, posed no objections to proposed amendments to the CPES Guidelines except on the proposed amendments concerning the issuance of the certificated of completion (Section 12.5) and the blacklisting of constructors (Section 12.7);
WHEREAS, the recommended revisions of the INFRACOM on the above-mentioned Sections have been considered and incorporated accordingly in the amendments hereto attached as Annex "1";
NOW, THEREFORE, Be it resolved, as it is hereby resolved, to approve, as the same is being approved, the proposed amendments to the CPES Implementing Guidelines for Infrastructure Projects for adoption by the government which shall take effect fifteen (15) days upon publication by the CIAP in a leading newspaper of nationwide coverage or the Official Gazette and furnishing the University of the Philippines (UP) Law Center a copy thereof.
