NOTICE
Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution dated 16 November 2020 which reads as follows:
"OCA IPI No. 19-4949-RTJ (Esperanza Anore Ybañes v. Presiding Judge Vicente S. De La Plaza II, Regional Trial Court, Ipil, Zamboanga Sibugay, Branch 36 and Presiding Judge Gino Jovito C. Aranas, Municipal Circuit Trial Court, Kabasalan-Siay-Payao, Zamboanga Sibugay [Judge-Designate, Municipal Circuit Trial Court, Tungawan-R.T. Lim, Tungawan, Zamboanga Sibugay]). — After a judicious study of complainant Esperanza Anore Ybañes' (complainant) allegations, the Court resolves to DISMISS her administrative complaint 1 against Judge Vicente S. De La Plaza II, Regional Trial Court of Ipil, Zamboanga Sibugay, Branch 36, and Judge Gino Jovito C. Aranas, Municipal Circuit Trial Court (MCTC) of Kabasalan-Siay-Payao, Zamboanga Sibugay, also Judge-Designate of MCTC, Tungawan-R.T. Lim, Tungawan, Zamboanga Sibugay, absent any showing of prima facie case against them.
It is well-settled that errors, if any, committed by a judge in the exercise of his adjudicative functions cannot be corrected through administrative proceedings, but should instead be assailed through available judicial remedies. Resort to and exhaustion of judicial remedies and a final ruling on the matter are prerequisites for the taking of appropriate measures against the judges concerned, whether of criminal, civil or administrative nature; 2 this, complainant failed to do, warranting the dismissal of the instant complaint.
