NOTICE
Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution dated23 April 2018which reads as follows: AcICHD
"G.R. No. 213945 (Lucila Yared and Heirs of the Late Ernesto Yared, Sr. vs. Land Bank of the Philippines). — For consideration is respondent Land Bank of the Philippines' (Land Bank) Motion for Reconsideration of the Court's Decision dated January 24, 2018, directing Land Bank to pay the petitioners the balance of P11,537,478.00 and legal interest thereon to be reckoned from September 25, 1996 until full payment of just compensation.
In the instant motion for reconsideration, Land Bank alleges that since it made a timely deposit of the initial valuation due the petitioners, there is no delay that would justify the imposition of legal interest on the remaining balance.
The Court is not persuaded.
A scrutiny of the motion reveals that the same is basically a mere reiteration of the arguments, raised in Land Bank's comment, which have already been duly considered and passed upon.
Thus, for Land Bank's failure to adduce any new or substantial argument that would warrant a reversal of the Court's decision, the Court resolves to DENY the motion with FINALITY.
However, the dispositive portion of the said Decision dated January 24, 2018 has a typographical error, which is hereby corrected to conform to the body of the decision. It shall now read as follows:
WHEREFORE, after judicious review of the records, the Court resolves to DIRECT respondent Land Bank of the Philippines to pay the remaining balance of P11,537,478.00 at a rate of twelve percent (12%) legal interest per annum from September 25, 1996 until June 30, 2013 and at a rate of six percent (6%) legal interest per annum from July 1, 2013 until full payment of just compensation.
No further pleadings will be entertained in this case. Let entry of judgment be issued immediately. TAIaHE
