NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution dated March 11, 2019 which reads as follows:
"G.R. No. 231252 (Agnes Yang vs. People of the Philippines)
For Petition for Review on Certiorari are the Resolutions dated June 24, 2016 1 and March 3, 2017 2 of the Court of Appeals (CA) in CA-G.R. SP No. 06924-MIN, which dismissed the petition for procedural infirmities.
After a perusal of the records of the case, this Court resolves to DENY the petition for failure of the petitioner to sufficiently show any reversible error in the assailed CA Resolutions.
In line with Nacar v. Gallery Frames, Inc., 3 petitioner is ORDERED to pay private complainant Floramae Salazar the total net amount of the face value of the three (3) checks which shall earn legal interest at the rate of 12% per annum reckoned from the time the said checks became due and demandable up to June 30, 2013 and 6% per annum from July 1, 2013 until fully paid.
WHEREFORE, premises considered, the Court DENIES the petition for lack of merit and AFFIRMS the Decision dated May 30, 2014 of the Regional Trial Court of Zamboanga City, Branch 16 with MODIFICATION as to the interest which must be twelve percent (12%) per annum reckoned from the time the said checks became due and demandable up to June 30, 2013 and six percent (6%) per annum from July 1, 2013 until fully paid.
SO ORDERED."
