Please take notice that the Court, First Division, issued a Resolution datedDecember 10, 2019which reads as follows:
"G.R. No. 238236 — WA TUK GO, petitioner, versus PEOPLE OF THE PHILIPPINES, respondent.
After reviewing the Petition and its annexes, inclusive of the Decision dated October 27, 2017 1 and Resolution dated March 14, 2018 2 of the Court of Appeals (CA) in CA-G.R. CR No. 39156, the Court resolves to DENY the petition and AFFIRM the Decision and Resolution of the CA since the petitioner failed to sufficiently show that the CA committed any reversible error in the assailed Decision and Resolution as to warrant the exercise of this Court's discretionary appellate jurisdiction.
The petitioner Wa Tuk Go failed to show that the Regional Trial Court (RTC) erred in denying his Demurrer to Evidence and finding him guilty of violating Section 5 (i) of Republic Act No. 9262. He further failed to show that the CA erred in affirming the RTC Decision. aScITE
In view of the foregoing, the Petition is hereby denied.
The petitioner's motion to admit the thereto attached annexes, praying that the Certification and Electronic List Travel Records issued by the Bureau of Immigration be admitted and form part of the motion to lift hold departure order filed on September 10, 2019 as additional Annexes; the compliance of Atty. Joaquin Arturo P. Parcero of Guico and Kho Law Offices, counsel for petitioner, with the Show Cause Resolution dated September 16, 2019; and the petitioner's reply to the comment on the petition for review on certiorari, are all NOTED.
SO ORDERED."
