This is a civil case regarding the complaint against Atty. J. John Saliba filed by Emilio Trinidad. The case involves the alleged mismanagement of Saliba's law office in connection with the filing of a falsified appeal bond. However, after investigation, the Board of Governors of the Integrated Bar of the Philippines (IBP) found no evidence of Saliba's mismanagement since the person responsible for the falsified bond was no longer employed at the time of the filing. Thus, the IBP recommended the dismissal of the complaint, which the Supreme Court adopted and approved, resulting in the dismissal of the case against Saliba.

NOTICE

Sirs/Mesdames :

Please take notice that the Court, Second Division, issued a Resolution dated 23 February 2022 which reads as follows:

"A.C. No. 10729 (Emilio Trinidad v. Atty. J. John Saliba.) — The Court NOTES the Notice of Resolution 1 dated 27 June 2020 of the Board of Governors of the Integrated Bar of the Philippines granting respondent's Motion for Reconsideration dated 20 May 2019. After finding there is no evidence of respondent's mismanagement of his office since the person responsible for filing the falsified appeal bond was no longer the law firm's employee at the time the appeal bond was filed, the Board of Governors of the Integrated Bar of the Philippines reversed and set aside its earlier Resolutions dated 08 November 2018 2 and 18 rune 2019 3 and thereby recommended the dismissal of the present complaint. 4

Acting on the complaint against respondent, the Court resolves to ADOPT and APPROVE the findings of fact, conclusions of law, and recommendation of the Board of Governors of the Integrated Bar of the Philippines in its Resolution dated 27 June 2020. Accordingly, the Court resolves to DISMISS the case against respondent Atty. J. John Saliba.

The Court NOTES:

1. the letter dated 04 August 2021 of the Integrated Bar of the Philippines (IBP) transmitting the documents pertaining to this case; and

2. the Notice of Resolution dated 08 November 2018 of the IBP Board of Governors, adopting with modification the findings of fact and recommendation of the Investigating Commissioner, and ordering the suspension of respondent from the practice of law for six (6) months.

SO ORDERED."
