NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution datedFebruary 11, 2019which reads as follows:
"G.R. No. 240979 — (Vicente U. Sy v. People of the Philippines)
After review of the records, the Court resolves to DENY the petition for (i) failure to accompany the petition with a clearly legible duplicate original or a certified true copy of the Court of Appeals (CA) February 28, 2018 Decision as required by Sections 4 (d) and 5 of Rule 45 of the Rules of Court in relation to Section 5 (d) of Rule 56 of the Rules of Court; (ii) insufficient or defective verification under Section 4, Rule 7 of the Rules of Court; and (iii) failure to sufficiently show that the CA committed any reversible error in its February 28, 2018 Decision and July 23, 2018 Resolution, 1 as to warrant the exercise of the Court's appellate jurisdiction.
As correctly ruled by the Regional Trial Court and CA, all the elements for the offense of falsification of public documents under Article 171 of the Revised Penal Code as well as violation of Section 3 (e) of Republic Act (R.A.) No. 3019 were proven by the prosecution's evidence warranting the affirmance of the judgment of the courts a quo convicting petitioner.
WHEREFORE, the February 28, 2018 Decision and July 23, 2018 Resolution of the Court of Appeals in CA-G.R. CR. No. 40146 are AFFIRMED. Petitioner is GUILTY beyond reasonable doubt of two (2) counts of falsification of public documents and is sentenced to suffer the penalty of six (6) months and one (1) day of prision correcional, as minimum, to six (6) years and one (1) day of prision mayor, as maximum, and to pay a fine of P2,500.00, for each count. Likewise, petitioner is GUILTY of one (1) count of violation of Section 3 (e) of R.A. No. 3019 and is sentenced to suffer the penalty of six (6) years and one (1) month, as minimum, to seven (7) years, as maximum, and PERPETUALLY DISQUALIFIED from holding any public office, and ORDERED to pay the amount of P8,316.00.
SO ORDERED."
