NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution datedJuly 3, 2019which reads as follows:
"G.R. No. 246272 [formerly UDK 16422] (Joselito Uy Sulapas v. Tiger Motor Sales Corp.). — The motion for extension of time to file petition for review under Rule 45 of the 1997 Rules of Civil Procedure filed by petitioner is GRANTED.
After review, the Court resolves to DENY the petition for failure to show that the Court of Appeals (CA) committed reversible error in affirming the ruling of the Regional Trial Court in favor of respondent, with modifications. Petitioner has failed to establish that a review or interest on the obligation and penalty charge should be reduced for being iniquitous, unconscionable, and excessive pursuant to our ruling in MCMP Construction Corp. v. Monark Equipment Corp. 1 HTcADC
WHEREFORE, the petition is DENIED. The Decision dated June 23, 2017 and Resolution dated February 22, 2019 of the Court of Appeals in CA-G.R. CV No. 04085 are AFFIRMED with the MODIFICATION that the interest on the obligation is reduced from 24% per annum to 12% per annum. The penalty charge is likewise reduced from 3% per month to 6% per annum.
