Please take notice that the Court, Second Division, issued a Resolution dated 06 February 2019which reads as follows:
"G.R. No. 242582 — Spouses Napoleon B. Manuel and Rea V. Lavarias versus Spouses Dionisio N. Allejos and Erlinda C. Macaranas, Sps. Armando Castillo and Virginia C. Macaranas, Sps. Jimmy M. Allejos and Jasmine Cayetano, Sps. Danny M. Allejos and Maribel Allejos, Lorna Fernandez and Avelino Cagaoan
After reviewing the instant Petition and its annexes, inclusive of the Court of Appeals (CA) Special Fifteenth (15th) Division's Decision 1 dated May 9, 2018 and the CA Former Special Fifteenth (15th) Division's Resolution 2 dated September 7, 2018 in CA-G.R. SP No. 153517, the Court resolves to DENY the instant Petition for failure of petitioners Sps. Napoleon Manuel and Rea Lavarias (petitioners Sps. Manuel) to sufficiently show that the CA committed any reversible error that warrants the exercise of the Court's discretionary appellate jurisdiction.
There is no cogent reason to reverse the findings of the lower courts and the CA that the essential elements of a valid complaint for Unlawful Detainer are absent in the instant case. The records clearly show that the respondents' initial possession of the subject property was not lawful, and that the supposed oral contract of lease was not proven. Further, the demand letters sent by the petitioners Sps. Manuel to the respondents clearly did not satisfy the requirements under Section 2, Rule 70 of the Rules of Court. CAIHTE
