Please take notice that the Court, First Division, issued a Resolution dated June 25, 2018which reads as follows:
"G.R. No. 238891 — Spouses Leopoldo and Teresita Gonzaga vs. Heirs of Virgilio and Teresita Padilla
The Motion for Extension of Time filed by the petitioners seeking an additional period of 30 days from the expiration of the reglementary period on April 19, 2018 within which to file their Petition for Review on Certiorari is hereby GRANTED.
Considering the allegations, issues, and arguments adduced in the instant Petition for Review on Certiorari, the Court resolves to DENY the same for: (a) failure to pay P1,000.00 for prayer for temporary restraining order/writ of preliminary injunction and P300.00 for Sheriffs' Trust Fund; and, (b) failure to show that the Court of Appeals in CA-G.R. CV No. 04413-MIN committed any reversible error. cEaSHC
We find no reason to overturn the findings of the Court of Appeals which, like the Regional Trial Court, Branch 1, Tagum City, had examined and had weighed the facts and evidence presented. Both the courts below have squarely addressed the issue of whether petitioners and Ciriaco Boja, Jr. had truly entered into a contract of sale. Their uniform factual findings on the matter is binding and conclusive upon this Court.
ACCORDINGLY, the Court hereby resolves to AFFIRM the assailed November 21, 2017 Decision and March 22, 2018 Resolution of the Court of Appeals in CA-G.R. CV No. 04413-MIN.
Petitioners, or their authorized representatives, may personally claim from the Cash Collection and Disbursement Division of this Court their excess payment for the legal fees in the amount of P470.00 under Official Receipt No. 0207763-SC-EP dated May 17, 2018.
