A.C. No. 10493 (Notice)

This is a civil case for disbarment (A.C. No. 10493) decided by the First Division of the Supreme Court of the Philippines on October 12, 2020. The case originated from a complaint filed by spouses Felix T. Chua and Bernardita A. Chua against attorneys Floripinas C. Buyser, Vergilio M. Egay, and Emmanuel M. Delgado for alleged violations of Canons 1, 18, and 29 of the Code of Professional Responsibility. However, Investigating Commissioner Atty. Sherwin C. De Joya recommended the dismissal of the charges, and the Board of Governors of the Integrated Bar of the Philippines resolved to adopt the findings of fact and recommendation of the Investigating Commissioner to dismiss the complaint against respondents. The Supreme Court, in a resolution, found the recommendation of the IBP to be fully supported by the evidence on record and applicable laws, and dismissed the case against Atty. Floripinas C. Buyser, considering the same as closed and terminated.

NOTICE

Sirs/Mesdames :

Please take notice that the Court, First Division, issued a Resolution datedOctober 12, 2020which reads as follows:

"A.C. No. 10493 [Formerly CBD Case No. 15-4565] (Spouses Felix T. Chua and Bernardita A. Chua v. Attys. Floripinas C. Buyser and Emmanuel M. Delgado.). — For resolution is a Complaint 1 dated May 28, 2014 filed before the Office of the Bar Confidant of the Supreme Court of the Philippines by complainants Felix T. Chua, Jr. and Bernardita A. Chua, seeking the disbarment of respondent Attys. Floripinas C. Buyser, former Presiding Judge of Branch 30 of the Regional Trial Court of Surigao City; Vergilio M. Egay; and Emmanuel M. Delgado, for alleged violations of Canons 1, 18, and 29 of the Code of Professional Responsibility, docketed as CBD Case No. 15-4565, now A.C. No. 10493.

In his Report and Recommendation 2 dated October 12, 2017, Investigating Commissioner Atty. Sherwin C. De Joya recommended the dismissal of the charges. Thereafter, in a Resolution 3 dated October 4, 2018, the Board of Governors of the IBP resolved to adopt the findings of fact and recommendation of the Investigating Commissioner to dismiss the complaint against respondents.

Finding the recommendation of the IBP to be fully supported by the evidence on record and applicable laws, the Court RESOLVES to DISMISS the case against Atty. Floripinas C. Buyser and consider the same as CLOSED and TERMINATED.
